1 | | AN ACT concerning courts.
|
2 | | Be it enacted by the People of the State of Illinois, |
3 | | represented in the General Assembly:
|
4 | | Section 5. The Juvenile Court Act of 1987 is amended by |
5 | | changing Section 5-125 as follows:
|
6 | | (705 ILCS 405/5-125)
|
7 | | Sec. 5-125. Concurrent jurisdiction. Any minor alleged to |
8 | | have violated a traffic, boating, or fish and
and game law,
or |
9 | | a municipal or county ordinance, may be prosecuted for the |
10 | | violation and if
found
guilty punished under any statute or |
11 | | ordinance relating to the violation,
without reference to the |
12 | | procedures set out in this Article, except that: |
13 | | (1) any
detention, must be in compliance with this |
14 | | Article; and |
15 | | (2) the confidentiality of records provisions in Part 9
|
16 | | of this Article shall apply to any law enforcement and
|
17 | | court records relating to prosecution of a minor under 18
|
18 | | years of age for a municipal or county ordinance violation |
19 | | or a violation of subsection (a) of Section 4 of the |
20 | | Cannabis Control Act or subsection (c) of Section 3.5 of |
21 | | the Drug Paraphernalia Control Act;
except that these |
22 | | confidentiality provisions shall not
apply to or affect any |
23 | | proceeding to adjudicate the
violation.
