2 | | AMENDMENT NO. ______. Amend Senate Bill 838 by replacing |
3 | | everything after the enacting clause with the following:

4 | | "Section 5. The Department of Public Health Powers and |
5 | | Duties Law of the
Civil Administrative Code of Illinois is |
6 | | amended by adding Section 2310-399.5 as follows: |
7 | | (20 ILCS 2310/2310-399.5 new) |
8 | | Sec. 2310-399.5. Veterans' cancer program. |
9 | | (a) The Department, subject to appropriation or other
|
10 | | available funding, shall conduct a program to promote awareness |
11 | | of cancer in veterans. The program may include, but
need not be |
12 | | limited to:
|
13 | | (1) Dissemination of information regarding the |
14 | | incidence of cancer in veterans, the risk factors |
15 | | associated with cancer, and the benefits of early detection |
16 | | and treatment.

1 | | (2) Promotion of information and counseling about |
2 | | treatment options.
|
3 | | (3) Establishment and promotion of referral services |
4 | | and screening
programs.
|
5 | | Beginning January 1, 2018, the program must include the |
6 | | development and
dissemination, through print and broadcast |
7 | | media, of public service
announcements that publicize the |
8 | | importance of cancer screening for
veterans.
|
9 | | (b) Subject to appropriation or other available funding,
|
10 | | the Veterans' Cancer Screening Program shall be
established in |
11 | | the Department of Public Health. The Program shall apply to the |
12 | | following persons and entities:
|
13 | | (1) uninsured and underinsured veterans; and
|
14 | | (2) non-profit organizations providing assistance to |
15 | | persons described
in paragraph (1).
|
16 | | An entity funded by the Program shall coordinate with other
|
17 | | local providers of cancer screening, diagnostic, follow-up,
|
18 | | education, and advocacy services for veterans to avoid |
19 | | duplication of effort. Any
entity funded by the Program shall |
20 | | comply with any applicable State
and federal standards |
21 | | regarding cancer screening.
|
22 | | Administrative costs of the Department shall not exceed 10%
|
23 | | of the funds allocated to the Program. Indirect costs of the
|
24 | | entities funded by this Program shall not exceed 12%. The
|
25 | | Department shall define "indirect costs" in accordance with
|
26 | | applicable State and federal law.

1 | | An entity funded by the Program shall collect data and
|
2 | | maintain records that are determined by the Department to be
|
3 | | necessary to facilitate the Department's ability to monitor and
|
4 | | evaluate the effectiveness of the entities and the Program.
|
5 | | Commencing with the Program's second year of operation, by |
6 | | January 1, 2019 and every January 1 thereafter, the
Department |
7 | | shall submit an annual report to the General Assembly and
the |
8 | | Governor. The report shall describe the activities
and |
9 | | effectiveness of the Program and shall include, but not be
|
10 | | limited to, the following types of information regarding those |
11 | | served
by the Program: (i) the number; and (ii) the ethnic, |
12 | | geographic, and age breakdown.
|
13 | | The Department or an entity funded by the Program shall
|
14 | | collect personal and medical information necessary to |
15 | | administer the
Program from an individual applying for services |
16 | | under the Program.
The information shall be confidential and |
17 | | shall not be disclosed
other than for purposes directly |
18 | | connected with the administration of
the Program or except as |
19 | | otherwise provided by law or pursuant to
prior written consent |
20 | | of the subject of the information.

21 | | The Department or any entity funded by the program may
|
22 | | disclose the confidential information to medical personnel and |
23 | | fiscal
intermediaries of the State to the extent necessary to |
24 | | administer
the Program, and to other State public health |
25 | | agencies or medical
researchers if the confidential |
26 | | information is necessary to carry out
the duties of those |
