| 1 | AMENDMENT TO SENATE BILL 1342

| 2 | AMENDMENT NO. ______. Amend Senate Bill 1342 by replacing | ||||||
| 3 | everything after the enacting clause with the following:

| 4 | "Section 5. The Criminal Code of 2012 is amended by adding | ||||||
| 5 | Section 48-11 as follows: | ||||||
| 6 | (720 ILCS 5/48-11 new) | ||||||
| 7 | Sec. 48-11. Unlawful use of an elephant in a traveling | ||||||
| 8 | animal act. | ||||||
| 9 | (a) Definitions. As used in this Section: | ||||||
| 10 | "Mobile or traveling animal housing facility" means a | ||||||
| 11 | transporting vehicle such as a truck, trailer, or railway car | ||||||
| 12 | used to transport or house animals while traveling to an | ||||||
| 13 | exhibition or other performance. | ||||||
| 14 | "Performance" mean an exhibition, public showing, | ||||||
| 15 | presentation, display, exposition, fair, animal act, circus, | ||||||
| 16 | ride, trade show, petting zoo, carnival, parade, race, or other | ||||||
| |||||||
| |||||||
| 1 | similar undertaking in which animals are required to perform | ||||||
| 2 | tricks, give rides, or participate as accompaniments for | ||||||
| 3 | entertainment, amusement, or benefit of a live audience. | ||||||
| 4 | "Traveling animal act" means any performance of animals | ||||||
| 5 | where animals are transported to, from, or between locations | ||||||
| 6 | for the purpose of a performance in a mobile or traveling | ||||||
| 7 | animal housing facility. | ||||||
| 8 | (b) A person commits unlawful use of an elephant in a | ||||||
| 9 | traveling animal act when he or she knowingly allows for the | ||||||
| 10 | participation of an African elephant (Loxodonta Africana) or | ||||||
| 11 | Asian elephant (Elephas maximus) protected under the federal | ||||||
| 12 | Endangered Species Act of 1973 in a traveling animal act. | ||||||
| 13 | (c) This Section does not apply to an exhibition of | ||||||
| 14 | elephants at a non-mobile, permanent institution, or other | ||||||
| 15 | facility. | ||||||
| 16 | (d) Sentence. Unlawful use of an elephant in a traveling | ||||||
| 17 | animal act is a Class A misdemeanor.".
