SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-35 new

    Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that for a person who is a resident in a facility licensed under the Specialized Mental Health Rehabilitation Act of 2013 or the Community-Integrated Living Arrangements Licensure and Certification Act for whom payments are made throughout a month and who is determined to be eligible for medical assistance, the State shall pay an amount in addition to the minimum monthly personal needs allowance authorized under the Social Security Act so that the person's total monthly personal needs allowance from both State and federal sources equals $100. Provides that any additional income needed by facilities for the purpose of providing adequate care shall be supplemented by the State; and that the personal needs allowance shall increase annually at the same rate as the Social Security cost-of-living adjustment to take effect on January 1 of each following year. Effective immediately.

1    AN ACT concerning public aid.
 
2    WHEREAS, The State must provide Medicaid recipients who
3reside in a specialized mental health rehabilitation facility
4or a community-integrated living arrangement a monthly
5personal needs allowance deducted from their monthly Social
6Security income; and
 
7    WHEREAS, The national minimum monthly personal needs
8allowance for an individual is $30; and
 
9    WHEREAS, Over three-quarters of states in the United States
10have personal needs allowances that are more than the $30
11minimum; and
 
12    WHEREAS, Illinois' monthly personal needs allowance is
13$30; and
 
14    WHEREAS, Illinois' personal needs allowance has not
15increased in accordance with Social Security cost-of-living
16adjustments since 1987; and
 
17    WHEREAS, Residents of specialized mental health
18rehabilitation facilities and community-integrated living
19arrangements depend on their personal needs allowance to live
20with independence and dignity as well as to save for moving out
21of the facility; therefore

1    Be it enacted by the People of the State of Illinois,
2represented in the General Assembly:
 
3    Section 5. The Illinois Public Aid Code is amended by
4adding Section 5-35 as follows:
 
5    (305 ILCS 5/5-35 new)
6    Sec. 5-35. Personal needs allowance. For a person who is a
7resident in a facility licensed under the Specialized Mental
8Health Rehabilitation Act of 2013 or the Community-Integrated
9Living Arrangements Licensure and Certification Act for whom
10payments are made under this Article throughout a month and who
11is determined to be eligible for medical assistance under this
12Article, the State shall pay an amount in addition to the
13minimum monthly personal needs allowance authorized under
14Section 1902(q) of Title XIX of the Social Security Act (42
15U.S.C. 1396a(q)) so that the person's total monthly personal
16needs allowance from both State and federal sources equals
17$100. Any additional income needed by facilities licensed under
18the Specialized Mental Health Rehabilitation Act of 2013 or the
19Community-Integrated Living Arrangements Licensure and
20Certification Act for the purpose of providing adequate care
21shall be supplemented by the State. The personal needs
22allowance shall increase annually at the same rate as the
23Social Security cost-of-living adjustment to take effect on
24January 1 of each following year.

1    Section 99. Effective date. This Act takes effect upon
2becoming law.
