AMENDMENT TO SENATE BILL 1562 




2    AMENDMENT NO. ______. Amend Senate Bill 1562 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The Abandoned Housing Rehabilitation Act is 
5amended  by changing Section 2 as follows:
 



6    (310 ILCS 50/2)  (from Ch. 67 1/2, par. 852)



7    Sec. 2. Definitions. As used in this Act:

8    (a) "Property" means any residential real estate which has 
9been continuously unoccupied by
persons legally in possession 
10for the preceding 1 year.

11    (b) "Nuisance" means any property which because of its 
12physical
condition or use is a public nuisance, or any property

13which constitutes a blight on the surrounding area, or any 
14property which
is not fit for human habitation under the 
15applicable fire, building and
housing codes.
"Nuisance" also 
16means any property on which any illegal activity involving

1controlled substances (as defined in the Illinois Controlled 
2Substances Act), methamphetamine (as defined in the 
3Methamphetamine Control and Community Protection Act), or

4cannabis (as defined in the Cannabis Control Act) takes place 
5or any property
on which any streetgang-related activity (as 
6defined in the Illinois Streetgang
Terrorism Omnibus 
7Prevention Act) takes place.

8    (c) "Organization" means any Illinois corporation, agency, 
9partnership,
association, firm or other entity consisting of 2 
10or more persons organized
and conducted on a not-for-profit 
11basis with no personal profit inuring to
anyone as a result of 
12its operation which
has among its purposes the improvement of 
13housing.

14    (d) "Parties in interest" means any owner or owners of 
15record, judgment
creditor,
tax purchaser, the applicable unit 
16of local government where the property is located, or other 
17party having any legal or equitable title or
interest in the 
18property.

19    (e) "Last known address" includes
the address where the 
20property
is located, or the address as listed in the tax 
21records or as listed
pursuant to any owner's registration

22ordinance duly adopted by a home rule unit of government.

23    (f) "Low or moderate income housing" means housing for 
24persons and families
with low or moderate incomes, provided 
25that the income limits for such
persons and families shall be 
26the same as those established by rule by the
Illinois Housing

1Development Authority in accordance with
subsection (g) of 
2Section 2 of the Illinois Housing Development Act, as
amended.

3    (g) "Rehabilitation" means the process of improving the 
4property,
including, but not limited to, bringing property into 
5compliance with
the applicable unit of local government's fire, 
6housing, licensing, zoning, and building codes.
