1 | AN ACT concerning courts.

2 | Be it enacted by the People of the State of Illinois,
| ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Judicial Privacy Act is amended by changing | ||||||
5 | Section 1-10 as follows: | ||||||
6 | (705 ILCS 90/1-10)
| ||||||
7 | Sec. 1-10. Definitions. As used in this Act: | ||||||
8 | "Government agency" includes all agencies, authorities, | ||||||
9 | boards, commissions, departments, institutions, offices, and | ||||||
10 | any other bodies politic and corporate of the State created by | ||||||
11 | the constitution or statute, whether in the executive, | ||||||
12 | judicial, or legislative branch; all units and corporate | ||||||
13 | outgrowths created by executive order of the Governor or any | ||||||
14 | constitutional officer, by the Supreme Court, or by resolution | ||||||
15 | of the General Assembly; or agencies, authorities, boards, | ||||||
16 | commissions, departments, institutions, offices, and any other | ||||||
17 | bodies politic and corporate of a unit of local government, or | ||||||
18 | school district.
| ||||||
19 | "Home address" includes a judicial officer's permanent | ||||||
20 | residence and any secondary residences affirmatively | ||||||
21 | identified by the judicial officer, but does not include a | ||||||
22 | judicial officer's work address.
| ||||||
23 | "Immediate family" includes a judicial officer's spouse, |

| |||||||
1 | child, parent, or any blood relative of the judicial officer or | ||||||
2 | the judicial officer's spouse who lives in the same residence.
| ||||||
3 | "Judicial officer" includes actively employed and former | ||||||
4 | or deceased :
| ||||||
5 | (1) Justices of the United States Supreme Court and the | ||||||
6 | Illinois Supreme Court; | ||||||
7 | (2) Judges of the United States Court of Appeals; | ||||||
8 | (3) Judges and magistrate judges of the United States | ||||||
9 | District Court; | ||||||
10 | (4) Judges of the United States Bankruptcy Court; | ||||||
11 | (5) Judges of the Illinois Appellate Court; and
| ||||||
12 | (6) Judges and associate judges of the Illinois Circuit | ||||||
13 | Courts.
| ||||||
14 | "Personal information" means a home address, home | ||||||
15 | telephone number, mobile telephone number, pager number, | ||||||
16 | personal email address, social security number, federal tax | ||||||
17 | identification number, checking and savings account numbers, | ||||||
18 | credit card numbers, marital status, and identity of children | ||||||
19 | under the age of 18.
| ||||||
20 | "Publicly available content" means any written, printed, | ||||||
21 | or electronic document or record that provides information or | ||||||
22 | that serves as a document or record maintained, controlled, or | ||||||
23 | in the possession of a government agency that may be obtained | ||||||
24 | by any person or entity, from the Internet, from the government | ||||||
25 | agency upon request either free of charge or for a fee, or in | ||||||
26 | response to a request under the Freedom of Information Act. |

1 | "Publicly post" or "publicly display" means to communicate | ||||||
2 | to another or
otherwise make available to the general public.
| ||||||
3 | "Written request" means written notice signed by a judicial | ||||||
4 | officer or a representative of the judicial officer's employer | ||||||
5 | requesting a government agency, person, business, or | ||||||
6 | association to refrain from posting or displaying publicly | ||||||
7 | available content that includes the judicial officer's | ||||||
8 | personal information.

10 | Section 99. Effective date. This Act takes effect upon | ||||||
11 | becoming law.
