SYNOPSIS AS INTRODUCED:
 
305 ILCS 5/5-5.27 new

    Amends the Medical Assistance Article of the Illinois Public Aid Code. Provides that in determining the assets of an individual applying for medical assistance, the Department of Healthcare and Family Services shall disregard the cash value of a life insurance policy or pre-paid funeral and burial contract or the equity value of any other assets which are intended to be used to pay the funeral and burial expenses of the individual. Provides that if the asset disregard requires federal approval, the Department shall submit the necessary application to the Centers for Medicare and Medicaid Services for a waiver or State Plan amendment to implement the asset disregard. Provides that implementation of the asset disregard shall be contingent on federal approval of the waiver or State Plan amendment.

1    AN ACT concerning public aid.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Public Aid Code is amended by
5adding Section 5-5.27 as follows:
 
6    (305 ILCS 5/5-5.27 new)
7    Sec. 5-5.27. Pre-paid funeral and burial policies;
8exemption. In determining the assets of an individual applying
9for medical assistance under this Article, the Department shall
10disregard the cash value of a life insurance policy or pre-paid
11funeral and burial contract or the equity value of any other
12assets which are intended to be used to pay the funeral and
13burial expenses of the individual. If the asset disregard
14described in this Section requires federal approval, the
15Department shall submit the necessary application to the
16Centers for Medicare and Medicaid Services for a waiver or
17State Plan amendment to implement the asset disregard.
18Implementation of the asset disregard shall be contingent on
19federal approval of the waiver or State Plan amendment.
