1    AN ACT concerning gaming.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Video Gaming Act is amended by adding
5Sections 43 and 79.5 and by changing Section 58 as follows:
 
6    (230 ILCS 40/43 new)
7    Sec. 43. Notice of alleged violation of Section 40. In all
8instances of an alleged violation of Section 40, the Board or
9its agents or designees shall provide written notice of the
10alleged violation to the affected licensed establishment,
11licensed fraternal establishment, licensed veterans
12establishment, or licensed truck stop establishment within 15
13days after the alleged occurrence of the violation.

15    Sec. 58. Location of terminals. Video gaming terminals in
16a licensed establishment, licensed fraternal establishment, or
17licensed veterans establishment must be located in an area that
18is restricted to persons over 21 years of age and the entrance
19to the area must be which is within the view of at least one
20employee of the establishment , who is over 21 years of age, of
21the establishment in which they are located.

1establishment must be:
2        (1) located in an area that is restricted to persons
3    over 21 years of age and the entrance to the area must be
4    within the view of at least one employee of the
5    establishment who is over 21 years of age; or
6        (2) monitored through a closed circuit television
7    monitor that is located on the premises and is within the
8    direct view of at least one employee of the establishment
9    who is over 21 years of age.
10    The placement of video gaming terminals in licensed
11establishments, licensed truck stop establishments, licensed
12fraternal establishments, and licensed veterans establishments
13shall be subject to the rules promulgated by the Board pursuant
14to the Illinois Administrative Procedure Act.

17    Sec. 79.5. Enforcement actions. The Board shall establish
18a policy and standards for compliance operations to investigate
19whether a licensed establishment, licensed fraternal
20establishment, licensed veterans establishment, or a licensed
21truck stop establishment is: (1) permitting any person under
22the age of 21 years to use or play a video gaming terminal in
23violation of this Act; or (2) furnishing alcoholic liquor to
24persons under 21 years of age in violation of the Liquor
25Control Act of 1934.

1    The policy and standards for compliance operations under
2this Section shall be similar to the model policy and
3guidelines for the operation of alcohol and tobacco compliance
4checks by local law enforcement officers adopted by the
5Illinois Law Enforcement Training Standards Board pursuant to
6subsection (c) of Section 6-16.1 of the Liquor Control Act of
71934. The Board shall adopt the policy and standards in the
8form of emergency rulemaking that shall be adopted no later
9than 90 days after the effective date of this amendatory Act of
10the 100th General Assembly and shall be immediately followed by
11permanent rulemaking on the same subject.
12    A licensed establishment, licensed fraternal
13establishment, licensed veterans establishment, or licensed
14truck stop establishment that is the subject of an enforcement
15action under this Section and is found, pursuant to the
16enforcement action, to be in compliance with this Act shall be
17notified by the Board that no violation was found within 30
18days after the finding.
 
19    Section 99. Effective date. This Act takes effect upon
20becoming law.
