| 1 | | a licensed establishment, licensed fraternal establishment, or |
| 2 | | licensed veterans establishment must be located
in an area that |
| 3 | | is restricted to persons over 21 years of age and the entrance |
| 4 | | to the area must be which is within the view of at least one |
| 5 | | employee of the establishment , who is over 21 years of age, of |
| 6 | | the
establishment in which they are located. |
| 7 | | Video gaming terminals in a licensed truck stop |
| 8 | | establishment must be: |
| 9 | | (1) located
in an area that is restricted to persons |
| 10 | | over 21 years of age and the entrance to the area must be |
| 11 | | within the view of at least one employee of the |
| 12 | | establishment who is over 21 years of age; or |
| 13 | | (2) monitored through a closed circuit television |
| 14 | | monitor that is located on the premises and is within the |
| 15 | | direct view of at least one employee of the establishment |
| 16 | | who is over 21 years of age. |
| 17 | | The placement of video gaming terminals in licensed |
| 18 | | establishments, licensed truck stop establishments, licensed |
| 19 | | fraternal establishments, and licensed veterans establishments |
| 20 | | shall be subject to the rules promulgated by the Board pursuant |
| 21 | | to the Illinois Administrative Procedure Act.

| 24 | | Sec. 79.5. Enforcement actions. The Board shall establish |
| 25 | | a policy and standards for compliance operations to investigate |

| 1 | | whether a licensed establishment, licensed fraternal |
| 2 | | establishment, licensed veterans establishment, or a licensed |
| 3 | | truck stop establishment is: (1) permitting any person under |
| 4 | | the age of 21 years to use or play a video gaming terminal in |
| 5 | | violation of this Act; or (2) furnishing alcoholic liquor to |
| 6 | | persons under 21 years of age in violation of the Liquor |
| 7 | | Control Act of 1934. |
| 8 | | The policy and standards for compliance operations under |
| 9 | | this Section shall be similar to the model policy and |
| 10 | | guidelines for the operation of alcohol and tobacco compliance |
| 11 | | checks by local law enforcement officers adopted by the |
| 12 | | Illinois Law Enforcement Training Standards Board pursuant to |
| 13 | | subsection (c) of Section 6-16.1 of the Liquor Control Act of |
| 14 | | 1934. The Board shall adopt the policy and standards in the |
| 15 | | form of emergency rulemaking that shall be adopted no later |
| 16 | | than 90 days after the effective date of this amendatory Act of |
| 17 | | the 100th General Assembly and shall be immediately followed by |
| 18 | | permanent rulemaking on the same subject. |
| 19 | | A licensed establishment, licensed fraternal |
| 20 | | establishment, licensed veterans establishment, or licensed |
| 21 | | truck stop establishment that is the subject of an enforcement |
| 22 | | action under this Section and is found, pursuant to the |
| 23 | | enforcement action, to be in compliance with this Act shall be |
| 24 | | notified by the Board that no violation was found within 30 |
| 25 | | days after the finding.
