1 | | AN ACT concerning transportation.
|
2 | | Be it enacted by the People of the State of Illinois,
|
3 | | represented in the General Assembly:
|
4 | | Section 5. The Illinois Vehicle Code is amended by changing |
5 | | Sections 12-806 and 12-806a as follows:
|
6 | | (625 ILCS 5/12-806) (from Ch. 95 1/2, par. 12-806)
|
7 | | Sec. 12-806. Identification, stop signal arms and special |
8 | | lighting when
not used as a school bus. |
9 | | (a) Except as provided in Section 12-806a,
whenever a |
10 | | school bus is operated for the purpose of transporting
|
11 | | passengers over 18 years of age other than persons in |
12 | | connection with an activity of the school
or religious |
13 | | organization which owns the school bus or for which the school
|
14 | | bus is operated, the "SCHOOL BUS" signs shall be covered or |
15 | | concealed and
the stop signal arm and flashing signal system |
16 | | shall not be operable
through normal controls.
|
17 | | (b) If a school district, religious organization, vendor of |
18 | | school buses busses , or school bus company whose main source of |
19 | | income is contracting with a school district or religious |
20 | | organization for the provision of transportation services in |
21 | | connection with the activities of a school district or |
22 | | religious organization, discards through either sale or |
23 | | donation, a school bus to an individual or entity that is not |

1 | | one of the aforementioned entities above, then the recipient of |
2 | | such school bus shall be responsible for immediately removing, |
3 | | covering, or concealing the "SCHOOL BUS" signs and any other |
4 | | insignia or words indicating the vehicle is a school bus, |
5 | | rendering inoperable or removing entirely the stop signal arm |
6 | | and flashing signal system, and painting the school bus a |
7 | | different color from those under Section 12-801 of this Code. |

Identification, stop signal arms , and |
11 | | special lighting on
school buses used to transport children |
12 | | outside of a school activity or persons in connection with a |
13 | | youth camp, child care
facility, or community based |
14 | | rehabilitation facility.
|
15 | | (a) Subject to the conditions in Subsection (c), a bus |
16 | | which meets any
of the special requirements for school buses in |
17 | | Section 12-801, 12-802,
12-803 , and 12-805 of this Code may be |
18 | | used for the purpose of transporting
persons 18 years of age or |
19 | | less . in connection with any of the following
facilities:

20 | | (i) any youth camp licensed under the Youth Camp Act; |
21 | | and
|
22 | | (ii) any child care facility licensed under the Child |
23 | | Care Act of 1969.
|
24 | | (b) Subject to the conditions in subsection (c), a bus |
25 | | which meets any
of the special requirements for school buses in |

1 | | Sections 12-801, 12-802,
12-803 and 12-805 of this Code may be |
2 | | used for the purpose of transporting
persons recognized as |
3 | | clients of a community based rehabilitation facility
which is |
4 | | accredited by the Commission on Accreditation of |
5 | | Rehabilitation
Facilities of Tucson, Arizona, and which is |
6 | | under a contractual agreement
with the Department of Human |
7 | | Services.

8 | | (c) A bus used for transportation as provided in subsection |
9 | | (a) or (b) shall
either (i) meet all of the special |
10 | | requirements for school buses in Section
12-801, 12-802, 12-803 |
11 | | and 12-805 or (ii) shall have the "SCHOOL BUS" signs
covered or |
12 | | concealed and the stop signal arm and flashing signal system
|
13 | | rendered inoperable through normal means . A bus which meets all |
14 | | of the
special requirements for school buses in Section 12-801, |
15 | | 12-802, 12-803 and
12-805 shall be operated by a person who has |
16 | | a valid and properly
classified driver's license issued by the |
17 | | Secretary of State and who
possesses a valid school bus driver |
18 | | permit or is accompanied and
supervised, for the specific |
19 | | purpose of training prior to routine operation
of a school bus, |
20 | | by a person who has held a valid school bus driver permit
for |
21 | | at least one year. A bus which has had the "SCHOOL BUS" signs |
22 | | covered
or concealed and the stop signal arm and flashing |
23 | | signal system rendered
inoperable through normal means may be |
24 | | operated by a person who has a valid
and properly classified |
25 | | driver's license issued by the Secretary of State.
