Amends the School Code. Provides that, upon knowledge of an incident of sexual assault by a student against another student, a school district shall report the incident to the State Board of Education; defines "sexual assault". Provides that the State Board shall post on its Internet website for each school year the total number of reported incidents statewide and in each school district. Provides that the State Board shall also report the data annually to the General Assembly no later than September 1 of each year.

2 | | Be it enacted by the People of the State of Illinois,

3 | | represented in the General Assembly:

4 | | Section 5. The School Code is amended by adding Sections |
5 | | 2-3.173, 10-20.67, and 34-18.60 as follows: |

7 | | Sec. 2-3.173. Sexual assault data. The State Board of |
8 | | Education shall post on its Internet website for each school |
9 | | year the total number of incidents reported under Sections |
10 | | 10-20.67 and 34-18.60 of this Code statewide and in each school |
11 | | district. The State Board shall also report the data annually |
12 | | to the General Assembly no later than September 1 of each year. |

15 | | (a) In this Section, "sexual assault" means any act of |
16 | | nonconsensual sexual conduct or sexual penetration, as defined |
17 | | under Section 11-0.1 of the Criminal Code of 2012, including, |
18 | | but not limited to, acts prohibited under Sections 11-1.20 |
19 | | through 11-1.60 of the Criminal Code of 2012. |
20 | | (b) Upon knowledge of an incident of sexual assault by a |
21 | | student against another student, a school district shall report |
22 | | the incident to the State Board of Education. |
