AMENDMENT TO SENATE BILL 2657




2    AMENDMENT NO. ______. Amend Senate Bill 2657 by replacing 
3everything after the enacting clause with the following:

 
 
4    "Section 5. The Consumer Fraud and Deceptive Business 
5Practices Act is amended  by adding Section 2VVV as follows:
 
6    (815 ILCS 505/2VVV new)
7    Sec. 2VVV. Credit card and debit card transaction fees 
8prohibited.
9    (a) As used in this Section, "transaction fee" means any 
10per transaction fee, item fee, item rate fee, per item rate 
11fee, communication fee, address verification fee, or 
12authorization fee imposed on the person or consumer by the 
13service provider for accepting or processing a credit or debit 
14card.
15    (b) No service provider accepting and processing credit or 
16debit card payments on behalf of a person may impose a

1transaction fee upon the person or the consumer. It is an 
2unlawful practice within the meaning of this Act for a service 
3provider to impose a transaction fee upon the person or 
4consumer in connection with the processing of credit or debit 
5card payments.
6    (c) This Section does not apply to State or local 
7government offices or agencies.".
