| 2 | | WHEREAS, The Illinois State Police and local law |
| 3 | | enforcement agencies operating in the State of Illinois should |
| 4 | | be using their gang databases appropriately to identify and |
| 5 | | target known gang activities; and
|
| 6 | | WHEREAS, Labeling a person as a gang member can result in |
| 7 | | adverse effects on someone's life and has led to assumptions |
| 8 | | being made about our young people who have done nothing wrong; |
| 9 | | and
|
| 10 | | WHEREAS, These lists should not be used to target or |
| 11 | | intimidate the citizens in our communities, and should solely |
| 12 | | be used as a tool to keep our law enforcement agents safe; and |
| 13 | | WHEREAS, Individuals from our communities should not be |
| 14 | | added to the shared gang and gang databases erroneously and |
| 15 | | should only be added if they pose a threat to public safety; |
| 16 | | and
|
| 17 | | WHEREAS, Giving our law enforcement agencies the most |
| 18 | | up-to-date tools necessary for targeting people who aim to do |
| 19 | | harm in our communities is of the utmost importance; and |
| 20 | | WHEREAS, Gang databases have been established to provide |
|

| 1 | | identifying information about violent criminal gangs and |
| 2 | | members of those gangs to law enforcement personnel; and
|
| 3 | | WHEREAS, Gang member information serves to warn law |
| 4 | | enforcement officers of the potential danger
posed by violent |
| 5 | | individuals, and promote the exchange of information about gang |
| 6 | | groups and gang
members to facilitate criminal investigations; |
| 7 | | and |
| 8 | | WHEREAS, Since gang member information is based, in part, |
| 9 | | on investigative information not previously
subject to |
| 10 | | independent judicial review, strict adherence to policy on the |
| 11 | | access, use, dissemination, and
security of gang information is |
| 12 | | necessary to ensure that individuals' constitutional rights, |
| 13 | | civil liberties,
civil rights, and privacy interests are |
| 14 | | protected; and |
| 15 | | WHEREAS, Law enforcement agencies should have standards of |
| 16 | | practice surrounding the issue of adding people to gang |
| 17 | | databases; and
|
| 18 | | WHEREAS, Law enforcement agencies should review the people |
| 19 | | who have been added to their gang database list and try to find |
| 20 | | a reasonable way to remove people that should not be on them; |
| 21 | | therefore, be it

| 1 | | RESOLVED, BY THE SENATE OF THE ONE HUNDREDTH GENERAL |
| 2 | | ASSEMBLY OF THE STATE OF ILLINOIS, that the Illinois Criminal |
| 3 | | Justice Information Authority (ICJIA) is directed to conduct a |
| 4 | | review of the shared gang databases operating in Illinois; and |
| 5 | | be it further |
| 6 | | RESOLVED, That this review should identify which law |
| 7 | | enforcement agencies use the shared gang and gang databases and |
| 8 | | the policies surrounding their use; and be it further |
| 9 | | RESOLVED, That the ICJIA shall commence this review as soon |
| 10 | | as is practical and report its findings by January 9, 2019; and |
| 11 | | be it further |
| 12 | | RESOLVED, That the report filed with the General Assembly |
| 13 | | shall be filed with the Secretary of the Senate and the Clerk |
| 14 | | of the House of Representatives in electronic form only, in the |
| 15 | | manner that the Secretary and Clerk shall direct; and be it |
| 16 | | further

| 17 | | RESOLVED, That a suitable copy of this resolution be |
| 18 | | delivered to the ICJIA.
