Amends the Illinois Vehicle Code. Provides that the Secretary of State may issue special registration plates designated as Peace Officers Memorial Foundation of Cook County license plates to active or retired Cook County peace officers and their family members, surviving family members of deceased law enforcement officers, and members of or donors to the Peace Officers Memorial Foundation of Cook County. Provides that the issuance and renewal fee shall be $25. Creates the Peace Officers Memorial Foundation of Cook County Fund. Makes corresponding changes in the Illinois Lottery Law, the State Finance Act, and the Illinois Income Tax Act.

AN ACT concerning transportation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The Illinois Lottery Law is amended by changing Section 21.10 as follows:

Sec. 21.10. Scratch-off for State police memorials.

(a) The Department shall offer a special instant scratch-off game for the benefit of State police memorials. The game shall commence on January 1, 2019 or as soon thereafter, at the discretion of the Director, as is reasonably practical. The operation of the game shall be governed by this Act and any rules adopted by the Department. If any provision of this Section is inconsistent with any other provision of this Act, then this Section governs.

(b) The net revenue from the State police memorials scratch-off game shall be deposited into the Criminal Justice Information Projects Fund and distributed equally, as soon as practical but at least on a monthly basis, to the Chicago Police Memorial Foundation Fund, the Police Memorial Committee Fund, and the Illinois State Police Memorial Park Fund, and the Peace Officers Memorial Foundation of Cook County Fund. Moneys transferred to the funds under this Section shall be used, subject to appropriation, to fund grants for building and maintaining memorials and parks; holding annual memorial commemorations; giving scholarships to children of officers killed or catastrophically injured in the line of duty, or those interested in pursuing a career in law enforcement; providing financial assistance to police officers and their families when a police officer is killed or injured in the line of duty; and providing financial assistance to officers for the purchase or replacement of bulletproof bullet proof vests to be used in the line of duty.

For purposes of this subsection, "net revenue" means the total amount for which tickets have been sold less the sum of the amount paid out in the prizes and the actual administrative expenses of the Department solely related to the scratch-off game under this Section.

(c) During the time that tickets are sold for the State police memorials scratch-off game, the Department shall not unreasonably diminish the efforts devoted to marketing any other instant scratch-off lottery game.

(d) The Department may adopt any rules necessary to implement and administer the provisions of this Section.

Section 10. The State Finance Act is amended by adding Section 5.891 as follows:

Section 15. The Illinois Income Tax Act is amended by changing Section 507HHH as follows:

Sec. 507HHH. Illinois Police Memorial checkoff.

(a) For taxable years ending on or after December 31, 2017, the Department must print on its standard individual income tax form a provision (i) indicating that if the taxpayer wishes to contribute to the Criminal Justice Information Projects Fund, as authorized by this amendatory Act of the 100th General Assembly, he or she may do so by stating the amount of the contribution (not less than $1) on the return and (ii) stating that the contribution will reduce the taxpayer's refund or increase the amount of payment to accompany the return. Failure to remit any amount of increased payment shall reduce the contribution accordingly. This Section does not apply to any amended return.

(b) Moneys deposited into the Criminal Justice Information Projects Fund under this Section shall be distributed equally, as soon as practical but at least on a monthly basis, to the Chicago Police Memorial Foundation Fund, the Police Memorial Committee Fund, and the Illinois State Police Memorial Park Fund, and the Peace Officers Memorial Foundation of Cook County Fund. Moneys transferred to the funds shall be used, subject to appropriation, to fund grants for building and maintaining memorials and parks; holding annual memorial commemorations; giving scholarships to children of officers killed or catastrophically injured in the line of duty, or those interested in pursuing a career in law enforcement; and providing financial assistance to police officers and their families when a police officer is killed or injured in the line of duty.

Section 20. The Illinois Vehicle Code is amended by adding Section 3-699.17 as follows:

Sec. 3-699.17. Peace Officers Memorial Foundation of Cook County license plates.

(a) The Secretary, upon receipt of all applicable fees and applications made in the form prescribed by the Secretary, may issue special registration plates designated as Peace Officers Memorial Foundation of Cook County license plates to active or retired Cook County peace officers and their family members, surviving family members of deceased law enforcement officers, and members of or donors to the Peace Officers Memorial Foundation of Cook County.

The special plates issued under this Section shall be affixed only to vehicles of the first division or motor vehicles of the second division weighing not more than 8,000 pounds.

Plates issued under this Section shall expire according to the multi-year procedure established by Section 3-414.1 of this Code.

(b) The design and color of the plates is wholly within the discretion of the Secretary. The Secretary may allow the plates to be issued as vanity plates or personalized under Section 3-405.1 of this Code. Appropriate documentation, as determined by the Secretary, shall accompany each application. The Secretary shall prescribe stickers or decals as provided under Section 3-412 of this Code. The Secretary must make a version of the special registration plates authorized under this Section in a form appropriate for motorcycles.

(c) An applicant for the special plate shall be charged a $25 fee for original issuance in addition to the appropriate registration fee. Of this fee, $10 shall be deposited into the Peace Officers Memorial Foundation of Cook County Fund and $15 shall be deposited into the Secretary of State Special License Plate Fund, to be used by the Secretary to help defray the administrative processing costs.

For each registration renewal period, a $25 fee, in addition to the appropriate registration fee, shall be charged. Of this fee, $23 shall be deposited into the Peace Officers Memorial Foundation of Cook County Fund and $2 shall be deposited into the Secretary of State Special License Plate Fund.

(d) The Peace Officers Memorial Foundation of Cook County Fund is created as a special fund in the State treasury. All moneys in the Peace Officers Memorial Foundation of Cook County Fund shall be paid, subject to appropriation by the General Assembly and distribution by the Secretary, as grants to the Peace Officers Memorial Foundation of Cook County for construction or maintenance of a memorial and park, holding an annual memorial commemoration, giving scholarships to children of Cook County peace officers killed or catastrophically injured in the line of duty, providing financial assistance to Cook County peace officers and their families when a Cook County peace officer is killed or injured in the line of duty, and paying the insurance premiums for Cook County peace officers who are terminally ill.
