| 1 | | AN ACT concerning local government.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 1. Short title. This Act may be cited as the Local |
| 5 | | Government Residential Inspection Limitation Act.
|
| 6 | | Section 5. Physical inspection of residential property. |
| 7 | | Except for a fire, medical, or police emergency or as otherwise |
| 8 | | permitted by Section 9 of the Fire Investigation Act, a unit of |
| 9 | | local government may not conduct a physical inspection of |
| 10 | | residential property without the voluntary consent of the owner |
| 11 | | or occupant of the property, a lawful warrant, or court order. |
| 12 | | This Section is a denial and limitation of home rule powers and |
| 13 | | functions under subsection (g) of Section 6 of Article VII of |
| 14 | | the Illinois Constitution.
