| 6 | | on page 2, line 10, by replacing "a mine examiner or" with "an |
| 7 | | Illinois a mine examiner or Illinois"; and |
| 8 | | on page 2, lines 15 and 20, by changing "organization" each |
| 9 | | time it appears to "organization representing coal miners"; and |
| 10 | | on page 2, by replacing lines 17 and 18 with the following: |
| 11 | | "underground coal mine and shall hold certificates a first |
| 12 | | class certificate of competency as an Illinois mine examiner."; |

| 2 | | "Section 7. The Coal Mining Act is amended by changing |
| 3 | | Sections 8.02 and 8.03 as follows:

| 5 | | Sec. 8.02.
There is created in the Department of Natural |
| 6 | | Resources, Office
of Mines and Minerals, a Miners' Examining |
| 7 | | Board which shall consist of 4
four miners' examining officers |
| 8 | | to be appointed by the Governor, 2 of whom must be from a labor |
| 9 | | organization recognized under the National Labor Relations Act |
| 10 | | representing coal miners, for a term of
2 years and until their |
| 11 | | successors are appointed and qualified. Terms of
office shall |
| 12 | | commence on the third Monday in January in each odd-numbered |
| 13 | | year.
Three of such officers shall constitute a quorum.
|
| 14 | | This amendatory Act of 1995 does not affect the terms of |
| 15 | | members of the
Miners' Examining Board holding office on the |
| 16 | | effective date of this amendatory
Act of 1995.
|
| 17 | | A complete record of the proceedings and acts of the |
| 18 | | Miners'
Examining Board shall be kept and preserved. Said |
| 19 | | officers shall hold no
other lucrative office or employment |
| 20 | | under the government of the United
States, State of Illinois, |
| 21 | | or any political division thereof or any
municipal corporation |
| 22 | | therein and each such officer before entering upon
the duties |
| 23 | | of his office shall subscribe and take the oath prescribed by
|
| 24 | | the Constitution of this State, and shall before entering upon |

| 1 | | the duties
of his office give a bond with sufficient surety to |
| 2 | | be approved by the
Governor, payable to the People of the State |
| 3 | | of Illinois in the penal sum
of $5,000, conditioned for the |
| 4 | | faithful discharge of the duties of office
and the delivery of |
| 5 | | all records, books, moneys, and other property
pertaining to |
| 6 | | his successor in office, which said bond shall be deposited
in |
| 7 | | the office of the Secretary of State. Vacancies shall be filled |
| 8 | | by
appointment as provided herein for the balance of the |
| 9 | | unexpired term.

No person shall be appointed to the Miners' |
| 13 | | Examining Board who
has not had at least 5 years' practical and |
| 14 | | continuous experience as an underground a coal
miner. The |
| 15 | | members of the Miners' Examining Board shall hold certificates |
| 16 | | of competency as an Illinois mine examiner. Two of the members |
| 17 | | of the Miners' Examining Board shall be representatives of a |
| 18 | | labor organization recognized under the National Labor |
| 19 | | Relations Act representing coal miners. Two of the members of |
| 20 | | the Miners' Examining Board shall be from the employing class. , |
| 21 | | and who has not been actually engaged in coal mining as a miner |
| 22 | | in
the State of Illinois continuously for 12 months next |
| 23 | | preceding his
appointment; except that a miners' examining |
| 24 | | officer may be appointed to
succeed himself.
