| 1 | | facility that: |
| 2 | | (1) receives only uncontaminated plastics that have |
| 3 | | been processed prior to receipt at the facility into a |
| 4 | | feedstock meeting the facility's specifications for a |
| 5 | | pyrolysis feedstock; and |
| 6 | | (2) uses heat in the absence of oxygen to process the |
| 7 | | uncontaminated plastics into fuels, chemicals, or chemical |
| 8 | | feedstocks that are returned to the economic mainstream in |
| 9 | | the form of raw materials or products. |
| 10 | | (b) Provided that permitting and construction has |
| 11 | | commenced prior to July 1, 2025, a pilot project allowing for a |
| 12 | | pyrolysis or gasification facility in accordance with this |
| 13 | | Section is permitted for a locally zoned and approved site in |
| 14 | | either Will County or Grundy County. |
| 15 | | (c) To the extent allowed by federal law, uncontaminated |
| 16 | | plastics that have been processed into a feedstock meeting |
| 17 | | feedstock specifications for a plastics gasification facility |
| 18 | | or plastics pyrolysis facility, and that are further processed |
| 19 | | by such a facility and returned to the economic mainstream in |
| 20 | | the form of raw materials or products, are considered recycled |
| 21 | | and are not subject to regulation as waste. |
| 22 | | (d) The Agency may propose to the Board for adoption, and |
| 23 | | the Board may adopt, rules establishing standards for materials |
| 24 | | accepted as feedstocks by plastics gasification facilities and |
| 25 | | plastics pyrolysis facilities, rules establishing standards |
| 26 | | for the management of feedstocks at plastics gasification |

| 1 | | facilities and plastics pyrolysis facilities, and any other |
| 2 | | rules, as may be necessary to implement and administer this |
| 3 | | Section. |
| 4 | | (e) If permitting and construction for the pilot project |
| 5 | | under subsection (b) has not commenced by July 1, 2025, this |
| 6 | | Section is repealed.

| 7 | | Section 99. Effective date. This Act takes effect July 1, |
| 8 | | 2020.
