AMENDMENT TO HOUSE BILL 2504 




2    AMENDMENT NO. ______. Amend House Bill 2504 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The State Records Act is amended  by adding 
5Section 17.5 as follows:
 
6    (5 ILCS 160/17.5 new)
7    Sec. 17.5. Destruction of records of law enforcement 
8misconduct.
9    (a) As used in this Section, "law enforcement agency" has 
10the meaning prescribed to that term in subsection (b) of 
11Section 17.
12    (b) After the effective date of this amendatory Act of the 
13101st General Assembly, a law enforcement agency may not 
14destroy any record relating to complaints, investigations, and 
15adjudications of misconduct by law enforcement officers of the 
16law enforcement agency.

1    Section 10. The Local Records Act is amended  by adding 
2Section 4.5 as follows:
 
3    (50 ILCS 205/4.5 new)
4    Sec. 4.5. Destruction of records of law enforcement 
5misconduct.
6    (a) As used in this Section, "law enforcement agency" has 
7the meaning prescribed to that term in subsection (b) of 
8Section 4.
