| 1 | | AN ACT concerning education.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The School Code is amended by adding Section |
| 5 | | 22-85 as follows:
|
| 6 | | (105 ILCS 5/22-85 new) |
| 7 | | Sec. 22-85. Detainment by law enforcement personnel, |
| 8 | | school resource officers, or other security personnel on school |
| 9 | | grounds. No student under 18 years of age may be questioned or |
| 10 | | detained by law enforcement personnel, a school resource |
| 11 | | officer, or other security personnel on school grounds in |
| 12 | | connection with a suspected or alleged criminal activity |
| 13 | | without the presence of the student's parent or guardian or a |
| 14 | | designee requested by the parent or guardian. A student 18 |
| 15 | | years of age or older may request the presence of his or her |
| 16 | | parent or guardian if he or she is questioned or detained under |
| 17 | | this Section, and the student must be notified of this right.

| 18 | | Section 99. Effective date. This Act takes effect upon |
| 19 | | becoming law.
