Amends the School Code. Provides that, beginning with the 2020-2021 school year, for an elementary school district that is designated by the State Board of Education as having a teacher shortage, each district superintendent shall receive for his or her services an annual salary of $175,000. Provides that an elementary school district may, by referendum approval of the school district's voters, provide a district superintendent a salary of more than $175,000 per year. Provides that if the referendum fails, the school district may not propose another referendum for at least 2 years after the date of the failed referendum.

AN ACT concerning education.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The School Code is amended by changing Section 10-16.7 and by adding Section 10-16.8 as follows:

Sec. 10-16.7. School board duties with respect to superintendent. In addition to all other powers and duties enumerated in this Article, the school board shall make all employment decisions pertaining to the superintendent, subject to any salary limitation under Section 10-16.8. The school board shall direct, through policy, the superintendent in his or her charge of the administration of the school district, including without limitation considering the recommendations of the superintendent concerning the budget, building plans, the locations of sites, the selection, retention, and dismissal of employees, and the selection of textbooks, instructional material, and courses of study. The school board shall evaluate the superintendent in his or her administration of school board policies and his or her stewardship of the assets of the district.

Sec. 10-16.8. District superintendent; salary.

(a) This Section applies only to an elementary school district that is designated by the State Board of Education as having a teacher shortage and, in such a case, only to an employment contract entered into, modified, or renewed on or after the effective date of this amendatory Act of the 101st General Assembly.

(b) Beginning with the 2020-2021 school year, a district superintendent shall receive for his or her services an annual salary of $175,000. An elementary school district may, by referendum approval of the school district's voters, provide a district superintendent a salary of more than $175,000 per year. The question of authorizing the school board to provide the district superintendent a salary of more than $175,000 a year must be submitted to the electors of the school district at a regular election and approved by a majority of the electors voting on the question. The school board must certify the question to the proper election authority, which must submit the question at an election in accordance with the Election Code. The election authority must submit the question in substantially the following form:

Shall the school board of (name of school district) be authorized to provide the district superintendent a salary of more than $175,000 per year? The election authority must record the votes as "Yes" or "No". If a majority of the electors voting on the question vote in the affirmative, the school district may thereafter provide the district superintendent a salary of more than $175,000 per year. If the referendum fails, the school district may not propose another referendum under this Section for at least 2 years after the date of the failed referendum.
