1    AN ACT concerning public aid.
  
 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:
  
 
 
4    Section 5. The Illinois Public Aid Code is amended  by 
5changing Section 12-4.7b as follows:
 



6    (305 ILCS 5/12-4.7b)



7    Sec. 12-4.7b. Exchanges of information; inmates. The 
8Department shall enter
into intergovernmental agreements
to 
9conduct monthly exchanges of information with
the
Illinois 
10Department of Corrections, the Cook County Department of

11Corrections, and the office of the sheriff of every other

12county to determine whether any individual included in an 
13assistance unit
receiving public aid
under any Article of this 
14Code is an
inmate in a facility operated by the Illinois 
15Department of Corrections, the
Cook County Department of

16Corrections, or a county sheriff. The Illinois Department of 
17Corrections, the Cook County Department of Corrections, and the 
18office of the sheriff of every other county shall honor all 
19intergovernmental agreements with the Department under this 
20Section and shall  provide all required information in a timely 
21manner. The Department shall review each month
the entire list 
22of individuals generated by the
monthly exchange and shall 
23verify the eligibility for benefits under this
Code for each

1individual on the list. The Department shall terminate benefits

2under this Code
for any individual determined to be ineligible 
3by this monthly review.
The Department shall use any legal 
4means available to recoup as an overpayment
any assistance

5provided to an individual for any period during which he or she 
6was ineligible
to receive the
assistance.

8    Section 99. Effective date. This Act takes effect upon 
9becoming law.
