AMENDMENT TO HOUSE BILL 2979 




2    AMENDMENT NO. ______. Amend House Bill 2979 by replacing 
3everything after the enacting clause with the following:


 
 
4    "Section 5. The Illinois Municipal Code is amended  by 
5adding Section 11-6-11 as follows:
 
6    (65 ILCS 5/11-6-11 new)
7    Sec. 11-6-11. Maximum weight of clothing and safety and 
8protective equipment. In municipalities with a population 
9greater than 1,000,000, a firefighter shall not be required to 
10carry fire protective clothing and safety and protective 
11equipment that weighs more than 70 pounds or more than 35% of 
12the firefighter's weight, whichever is less.
13    A home rule unit may not regulate fire protective clothing 
14and safety and protective equipment in a manner inconsistent 
15with the provisions of this Article. This Section is a 
16limitation under subsection (i) of Section 6 of Article VII of

1the Illinois Constitution on the concurrent exercise by home 
2rule units of powers and functions exercised by the State.
 
 
3    Section 99. Effective date. This Act takes effect upon 
4becoming law.".
