| 2 | | AMENDMENT NO. ______. Amend House Bill 3226 by replacing |
| 3 | | everything after the enacting clause with the following:

| 4 | | "Section 5. The Illinois Vehicle Code is amended by |
| 5 | | changing Section 11-500 as follows: |
| 6 | | (625 ILCS 5/11-500) (from Ch. 95 1/2, par. 11-500)
|
| 7 | | Sec. 11-500. Definitions. For the purposes of interpreting |
| 8 | | Sections
6-206.1 and 6-208.1 of this Code, "first offender" |
| 9 | | shall mean any person
who has not had a previous conviction or |
| 10 | | court-assigned court assigned supervision for
violating |
| 11 | | Section 11-501, or a similar provision of a local ordinance,
or |
| 12 | | a conviction in any other state for a violation of driving |
| 13 | | while under
the influence or a similar offense where the cause |
| 14 | | of action is the same
or substantially similar to this Code or |
| 15 | | similar offenses committed on a military installation, or any |
| 16 | | person who has not had a driver's license suspension pursuant |

| 1 | | to paragraph 6 of subsection (a) of Section 6-206 as the result |
| 2 | | of refusal of chemical testing in another state, or any
person |
| 3 | | who has not had a driver's license
suspension or revocation for |
| 4 | | violating Section 11-501.1 within 10 5 years prior to the date |
| 5 | | of
the
current offense, except in cases where the driver |
| 6 | | submitted to
chemical testing resulting in an alcohol |
| 7 | | concentration of 0.08 or
more,
or any amount of a drug, |
| 8 | | substance, or compound in such person's blood, other bodily |
| 9 | | substance, or
urine resulting from the unlawful use or |
| 10 | | consumption of cannabis listed in
the Cannabis Control Act, a |
| 11 | | controlled substance listed in the
Illinois
Controlled |
| 12 | | Substances Act, or an intoxicating compound listed in the Use
|
| 13 | | of
Intoxicating Compounds Act, or methamphetamine as listed in |
| 14 | | the Methamphetamine Control and Community Protection Act and
|
| 15 | | was subsequently found not guilty of violating Section 11-501, |
| 16 | | or a similar
provision of a local ordinance. |
