| 1 | | AN ACT concerning local government.
|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Counties Code is amended by changing Section |
| 5 | | 4-7001 as follows:
|
| 6 | | (55 ILCS 5/4-7001) (from Ch. 34, par. 4-7001)
|
| 7 | | Sec. 4-7001. Coroner's fees. The fees of the
coroner's |
| 8 | | office shall be as follows:
|
| 9 | | 1. For a copy of a transcript of sworn testimony: $5.00 |
| 10 | | per page.
|
| 11 | | 2. For a copy of an autopsy report (if not included in |
| 12 | | transcript):
$50.00.
|
| 13 | | 3. For a copy of the verdict of a coroner's jury: |
| 14 | | $5.00.
|
| 15 | | 4. For a copy of a toxicology report: $25.00.
|
| 16 | | 5. For a print of or an electronic file containing a |
| 17 | | picture obtained by the coroner: actual cost or
$3.00, |
| 18 | | whichever is greater.
|
| 19 | | 6. For each copy of miscellaneous reports, including |
| 20 | | artist's
drawings but not including police reports: actual |
| 21 | | cost or $25.00,
whichever is greater.
|
| 22 | | 7. For a coroner's or medical examiner's permit to |
| 23 | | cremate a dead
human body: $100.00 $50.00. The coroner may |

| 1 | | waive, at his or her discretion, the permit fee if the |
| 2 | | coroner determines that the person is indigent and unable |
| 3 | | to pay the permit fee or under other special circumstances.
|
| 4 | | 8. For a certified copy of a transcript of sworn |
| 5 | | testimony of a coroner's inquest made by written request |
| 6 | | declaring the request is for research or genealogy |
| 7 | | purposes: $15.00 for the entire transcript. A request shall |
| 8 | | be deemed a proper request for purpose of research or |
| 9 | | genealogy if the requested inquest occurred not less than |
| 10 | | 20 years prior to the date of the written request. The |
| 11 | | transcript shall be stamped with the words "FOR GENEALOGY |
| 12 | | OR RESEARCH PURPOSES ONLY". |
| 13 | | The coroner may waive, at his or her discretion, fees under |
| 14 | | this Section if the coroner determines that the person is |
| 15 | | indigent and unable to pay the permit fee or under other |
| 16 | | special circumstances as determined by the coroner. |
| 17 | | All of which fees shall be certified by the court; in the |
| 18 | | case of
inmates of any State charitable or penal institution, |
| 19 | | the fees shall be
paid by the operating department or |
| 20 | | commission, out of the State
Treasury. The coroner shall file |
| 21 | | his or her claim in probate for his or
her fees and he or she |
| 22 | | shall render assistance to the State's attorney
in the |
| 23 | | collection of such fees out of the estate of the deceased. In
|
| 24 | | counties of less than 1,000,000 population, the State's |
| 25 | | attorney shall
collect such fees out of the estate of the |
| 26 | | deceased.

| 1 | | Except as otherwise provided in this Section, whenever the |
| 2 | | coroner is
required by law to perform any of the duties of the |
| 3 | | office of the
sheriff, the coroner is entitled to the like fees |
| 4 | | and compensation as
are allowed by law to the sheriff for the |
| 5 | | performance of similar
services.

| 6 | | Except as otherwise provided in this Section, whenever the |
| 7 | | coroner of
any county is required to travel in the performance |
| 8 | | of his or her
duties, he or she shall receive the same mileage |
| 9 | | fees as are authorized
for the sheriff of such county.
|
| 10 | | All fees under this Section collected by or on behalf of |
| 11 | | the coroner's
office shall be paid over to the county treasurer |
| 12 | | and deposited into a special account in the county treasury. |
| 13 | | Moneys in the special account shall be used solely for the |
| 14 | | purchase of electronic and forensic identification equipment |
| 15 | | or other related supplies and the operating expenses of the |
| 16 | | coroner's office.
