Amends the Humane Care for Animals Act. Provides that a person may not willfully and maliciously annoy, harass, taunt, injure, kill, or otherwise harm any animal (rather than a guide, hearing, or support dog) that provides assistance to a person with a disability. Sets forth penalties. Defines "assistance animal". Effective immediately.

|
| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Humane Care for Animals Act is amended by |
| 5 | | changing Section 7.15 and by adding Section 2.01i as follows: |
| 6 | | (510 ILCS 70/2.01i new) |
| 7 | | Sec. 2.01i. Assistance animal. "Assistance animal" means |
| 8 | | an animal trained by a licensed or certified person, |
| 9 | | organization, or agency to assist a person who has a physical, |
| 10 | | sensory, intellectual, developmental, psychiatric, or mental |
| 11 | | disability in one or more daily life activities. "Assistance |
| 12 | | animal" includes guide dogs, leader dogs, hearing ear dogs, and |
| 13 | | any animal trained to do work or perform tasks for the benefit |
| 14 | | of a person with a disability, including, but not limited to: |
| 15 | | (1) pulling a wheelchair; |
| 16 | | (2) providing balance or stability support; |
| 17 | | (3) retrieving objects; and |
| 18 | | (4) providing assistance and support during a medical, |
| 19 | | psychological, or emotional crisis.

| 1 | | (a) A person may not willfully and maliciously annoy, |
| 2 | | taunt, tease, harass,
torment, beat, or strike an assistance |
| 3 | | animal a guide, hearing, or support dog or otherwise engage
in |
| 4 | | any conduct directed toward an assistance animal a guide, |
| 5 | | hearing, or support dog that is likely
to impede or interfere |
| 6 | | with the assistance animal's dog's performance of its duties or |
| 7 | | that places
the blind, hearing impaired, or person with a |
| 8 | | physical disability being served or
assisted by the assistance |
| 9 | | animal dog in danger of injury.

| 10 | | (b) A person may not willfully and maliciously torture, |
| 11 | | injure, or kill an assistance animal a
guide, hearing, or |
| 12 | | support dog.
|
| 13 | | (c) A person may not willfully and maliciously permit an |
| 14 | | animal a dog that is owned,
harbored, or controlled by the |
| 15 | | person to cause injury to or the death of an assistance animal |
| 16 | | a
guide, hearing, or support dog while the assistance animal |
| 17 | | guide, hearing, or support dog is in
discharge of its duties.

| 18 | | (d) A person convicted of violating this Section is guilty |
| 19 | | of a Class A
misdemeanor. A second or subsequent violation is a |
| 20 | | Class 4 felony. A person
convicted of violating subsection (b) |
| 21 | | or (c) of this Section is guilty of a
Class 4 felony if the |
| 22 | | assistance animal dog is killed or totally disabled, and may be |
| 23 | | ordered
by the court to make restitution to the person with a |
| 24 | | disability having custody or
ownership of the assistance animal |
| 25 | | dog for veterinary bills and replacement costs of the |
| 26 | | assistance animal dog.
