| 3 | | Childhood Vaccine Injury Act of 1986,
which states that no |
| 4 | | "vaccine manufacturer shall be liable in a civil action for |
| 5 | | damages arising
from a vaccine-related injury or death |
| 6 | | associated with the administration of a vaccine after
October |
| 7 | | 1, 1988, if the injury or death resulted from side effects that |
| 8 | | were unavoidable even
though the vaccine was properly prepared |
| 9 | | and was accompanied by proper directions and
warnings"; and

| 10 | | WHEREAS, In 2011, the United States Supreme Court ruled in |
| 11 | | Bruesewitz v. Wyeth that the
"National Childhood Vaccine Injury |
| 12 | | Act pre-empts all design-defect claims against vaccine
|
| 13 | | manufacturers brought by plaintiffs who seek compensation for |
| 14 | | injury or death caused by
vaccine side effects"; and
|
| 15 | | WHEREAS, Our individual human rights should outweigh the |
| 16 | | profits of pharmaceutical
companies, and individuals should |
| 17 | | have the ability to hold vaccine manufacturers liable for
|
| 18 | | design defects that result in adverse side effects from |
| 19 | | vaccines; and
|
| 20 | | WHEREAS, The European Union has found a way to allow |
| 21 | | evidence-based lawsuits to hold
vaccine manufacturers liable |
| 22 | | without destabilizing the European health care system; |
