1 | AN ACT concerning government.

2 | Be it enacted by the People of the State of Illinois, | ||||||
3 | represented in the General Assembly:
| ||||||
4 | Section 5. The Toll Bridge Act is amended by changing | ||||||
5 | Section 7 as follows:
| ||||||
6 | (605 ILCS 115/7) (from Ch. 137, par. 7)

7 | Sec. 7. Toll rates; electronic toll collection. | ||||||
8 | (a) The county board shall fix the rates of toll, and may | ||||||
9 | from time to
time, alter and change the same, including by | ||||||
10 | establishing a toll rate schedule, setting a maximum toll rate | ||||||
11 | that may be adjusted from time to time, or by establishing | ||||||
12 | another toll rate structure, and in case of the neglect of the | ||||||
13 | owner of
the bridge to keep the same in proper repair and safe | ||||||
14 | for the crossing of
persons and property, may prohibit the | ||||||
15 | taking of toll. | ||||||
16 | (b) Notwithstanding any law to the contrary, the county | ||||||
17 | board may enter into an agreement establishing a toll rate | ||||||
18 | schedule for a period not to exceed 99 years. This amendatory | ||||||
19 | Act of the 101st General Assembly is declarative of existing | ||||||
20 | law and shall be given retroactive effect. | ||||||
21 | (c) Except as regarding toll bridges or as otherwise | ||||||
22 | provided by law, nothing in Public Act 101-398 this amendatory | ||||||
23 | Act of the 101st General Assembly shall be construed to |

1 | authorize a county, municipality, local government, or private | ||||||
2 | operator to impose a toll upon any public road, street, or | ||||||
3 | highway; nor shall any provision of Public Act 101-398 this | ||||||
4 | amendatory Act of the 101st General Assembly be construed to | ||||||
5 | authorize, pursuant to an intergovernmental agreement or | ||||||
6 | otherwise, the imposition of any toll upon any public road, | ||||||
7 | street, or highway. | ||||||
8 | (d) The General Assembly finds that electronic toll | ||||||
9 | collection systems in Illinois should be standardized to | ||||||
10 | promote safety, efficiency, and traveler convenience. If | ||||||
11 | electronic toll collection is used on such bridge, the county | ||||||
12 | shall cause the configuration of the electronic toll collection | ||||||
13 | system to be compatible with the electronic toll collection | ||||||
14 | system used by the Illinois State Toll Highway Authority. The | ||||||
15 | municipality or private operator may enter into an agreement | ||||||
16 | with the Illinois State Toll Highway Authority to provide for | ||||||
17 | such compatibility or to have the Authority provide electronic | ||||||
18 | toll collection or toll violation enforcement services. Any | ||||||
19 | toll bridges in Winnebago County that are in operation and | ||||||
20 | collecting tolls on the effective date of this amendatory Act | ||||||
21 | of the 97th General Assembly are exempt from the provisions of | ||||||
22 | the Act.

25 | becoming law.
