AMENDMENT TO SENATE BILL 717

2    AMENDMENT NO. ______. Amend Senate Bill 717 by replacing
3everything after the enacting clause with the following:
 
4    "Section 5. The Firearm Owners Identification Card Act is
5amended by changing Section 9.5 as follows:
 
6    (430 ILCS 65/9.5)
7    Sec. 9.5. Revocation of Firearm Owner's Identification
8Card.
9    (a) A person who receives a revocation notice under Section
109 of this Act shall, within 48 hours of receiving notice of the
11revocation:
12        (1) surrender his or her Firearm Owner's
13    Identification Card to the local law enforcement agency
14    where the person resides. The local law enforcement agency
15    shall provide the person a receipt and transmit the Firearm
16    Owner's Identification Card to the Department of State

1    Police; and
2        (2) complete a Firearm Disposition Record on a form
3    prescribed by the Department of State Police and place his
4    or her firearms in the location or with the person reported
5    in the Firearm Disposition Record. The form shall require
6    the person to disclose:
7            (A) the make, model, and serial number of each
8        firearm owned by or under the custody and control of
9        the revoked person;
10            (B) the location where each firearm will be
11        maintained during the prohibited term; and
12            (C) if any firearm will be transferred to the
13        custody of another person, the name, address and
14        Firearm Owner's Identification Card number of the
15        transferee.
16    (b) The local law enforcement agency shall provide a copy
17of the Firearm Disposition Record to the person whose Firearm
18Owner's Identification Card has been revoked and to the
19Department of State Police.
20    (c) If the person whose Firearm Owner's Identification Card
21has been revoked fails to comply with the requirements of this
22Section, the sheriff or law enforcement agency where the person
23resides may petition the circuit court to issue a warrant to
24search for and seize the Firearm Owner's Identification Card
25and firearms in the possession or under the custody or control
26of the person whose Firearm Owner's Identification Card has

1been revoked.
2    (d) A violation of subsection (a) of this Section is a
3Class A misdemeanor and shall also be punishable in accordance
4with Section 7-702.1 of the Illinois Vehicle Code.
5    (e) The observation of a Firearm Owner's Identification
6Card in the possession of a person whose Firearm Owner's
7Identification Card has been revoked constitutes a sufficient
8basis for the arrest of that person for violation of this
9Section.
10    (f) Within 30 days after the effective date of this
11amendatory Act of the 98th General Assembly, the Department of
12State Police shall provide written notice of the requirements
13of this Section to persons whose Firearm Owner's Identification
14Cards have been revoked, suspended, or expired and who have
15failed to surrender their cards to the Department.
16    (g) A person whose Firearm Owner's Identification Card has
17been revoked and who received notice under subsection (f) shall
18comply with the requirements of this Section within 48 hours of
19receiving notice.

21    Section 10. The Illinois Vehicle Code is amended by adding
22Section 7-702.3 as follows:

24    Sec. 7-702.3. Suspension of driver's license for failure to

1comply with Firearm Owner's Identification Card revocation
2requirements. The Secretary of State shall suspend the driver's
3license of an individual upon certification by the Department
4of State Police, in a manner and form prescribed by the
5Secretary of State, that the person has failed to comply with
6subsection (a) of Section 9.5 of the Firearm Owners
7Identification Card Act. The person's driver's license shall be
8suspended until the Secretary receives authenticated
9documentation from the Department of State Police that there
10has been sufficient compliance with subsection (a) of Section
119.5 of the Firearm Owners Identification Card Act. The
12Secretary may reinstate the person's driver's license if
13notified by the Department of State Police that the person has
14complied with subsection (a) of Section 9.5 of the Firearm
15Owners Identification Card Act.".
