    Amends the Illinois Vehicle Code. Makes a technical change in a Section concerning driving under the influence of alcohol or drugs.

1    AN ACT concerning transportation.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Vehicle Code is amended by changing
5Section 11-500 as follows:
 
6    (625 ILCS 5/11-500)  (from Ch. 95 1/2, par. 11-500)
7    Sec. 11-500. Definitions. For the the purposes of
8interpreting Sections 6-206.1 and 6-208.1 of this Code, "first
9offender" shall mean any person who has not had a previous
10conviction or court assigned supervision for violating Section
1111-501, or a similar provision of a local ordinance, or a
12conviction in any other state for a violation of driving while
13under the influence or a similar offense where the cause of
14action is the same or substantially similar to this Code or
15similar offenses committed on a military installation, or any
16person who has not had a driver's license suspension pursuant
17to paragraph 6 of subsection (a) of Section 6-206 as the result
18of refusal of chemical testing in another state, or any person
19who has not had a driver's license suspension or revocation for
20violating Section 11-501.1 within 5 years prior to the date of
21the current offense, except in cases where the driver submitted
22to chemical testing resulting in an alcohol concentration of
230.08 or more, or any amount of a drug, substance, or compound

1in such person's blood, other bodily substance, or urine
2resulting from the unlawful use or consumption of cannabis
3listed in the Cannabis Control Act, a controlled substance
4listed in the Illinois Controlled Substances Act, or an
5intoxicating compound listed in the Use of Intoxicating
6Compounds Act, or methamphetamine as listed in the
7Methamphetamine Control and Community Protection Act and was
8subsequently found not guilty of violating Section 11-501, or a
9similar provision of a local ordinance.
