1 AMENDMENT TO SENATE BILL 1353

2 AMENDMENT NO. ______. Amend Senate Bill 1353 on page 15,

3 line 10, after "18b-109", by inserting "and by adding Section

4 18b-104.5"; and

5 on page 21, by inserting immediately below line 13 the

6 following:

7 "(625 ILCS 5/18b-104.5 new)

8 Sec. 18b-104.5. Personnel transfers. The personnel

9 responsible for administering this Chapter are transferred

10 from the transferring agency designated by the Governor to the

11 Department of State Police. The status and rights of the

12 employees and the State or its transferring agency under the

13 Personnel Code, the Illinois Public Labor Relations Act, and

14 applicable collective bargaining agreements or under any

15 pension, retirement, or annuity plan shall not be affected by

16 this amendatory Act of the 101st General Assembly. Under the

1 direction of the Governor, the Director, in consultation with

2 the transferring agencies and labor organizations representing

3 the affected employees, shall identify each position and

4 employee who is engaged in the performance of functions

5 transferred to the Department, or engaged in the administration

6 of a law the administration of which is transferred to the

7 Department, to be transferred to the Department. An employee

8 engaged primarily in providing administrative and

9 investigative support to the Illinois Motor Carrier Safety

10 Assistance Program may be considered engaged in the performance

11 of functions transferred to the Department.".
