| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Project Labor Agreements Act is amended by |
| 5 | | changing Section 10 as follows:
|

| 7 | | Sec. 10. Public works projects. On projects totaling |
| 8 | | $15,000,000 or more in costs a project-by-project basis, a |
| 9 | | State department, agency, authority, board, or instrumentality |
| 10 | | that is under the control of the Governor shall, on a |
| 11 | | project-by-project basis, include a project labor agreement on |
| 12 | | a public works project when that department, agency, authority, |
| 13 | | board, or instrumentality has determined that the agreement |
| 14 | | advances the State's interests of cost, efficiency, quality, |
| 15 | | safety, timeliness, skilled labor force, labor stability, or |
| 16 | | the State's policy to advance minority-owned and women-owned |
| 17 | | businesses and minority and female employment. For purposes of |
| 18 | | this Act, any corrective action performed pursuant to Title XVI |
| 19 | | of the Environmental Protection Act for which payment from the |
| 20 | | Underground Storage Tank Fund is requested shall be considered |
| 21 | | a public works project.
