| 1 | | reporting of mammography screening, including, but not limited |
| 2 | | to, the Breast Imaging Reporting and Data System of the |
| 3 | | American College of Radiology, and any equivalent new terms, as |
| 4 | | such guidelines or systems are updated. |
| 5 | | (b) If a patient's mammogram demonstrates dense breast |
| 6 | | tissue, the provider of mammography services shall provide in a |
| 7 | | summary of the mammography report sent to the patient in |
| 8 | | accordance with the federal Mammography Quality Standards Act a |
| 9 | | notice substantially similar to the following: |
| 10 | | "Your mammogram indicates you have dense breast |
| 11 | | tissue. Dense breast tissue is normal and identified on |
| 12 | | mammograms in about 50% of women. Dense breast tissue can |
| 13 | | make it more difficult to detect cancer on a mammogram and |
| 14 | | may be associated with an increased risk for breast cancer. |
| 15 | | Despite these limitations, screening mammograms have been |
| 16 | | proven to save lives. Continue to have routine screening |
| 17 | | mammography whether or not additional exams are suggested |
| 18 | | for you. This information is provided to raise your |
| 19 | | awareness of the impact of breast density on cancer |
| 20 | | detection. For further information about dense breast |
| 21 | | tissue, as well as other breast cancer risk factors, |
| 22 | | contact your breast imaging health care provider.". |
| 23 | | (c) A facility that performs mammography may update the |
| 24 | | language in the notice under subsection (b) to reflect advances |
| 25 | | in science and technology as long as it continues to notify |
| 26 | | patients about dense breast tissue and its effect on the |

| 1 | | accuracy of mammograms and encourages patients to discuss the |
| 2 | | issue with their health care provider. |
| 3 | | (d) This Section does not create a duty of care or other |
| 4 | | legal obligation beyond the duty to provide notice as set forth |
| 5 | | in this Section.
