AMENDMENT TO SENATE BILL 1597

2    AMENDMENT NO. ______. Amend Senate Bill 1597 by replacing
3everything after the enacting clause with the following:

"ARTICLE 1.

 
5    Section 1-5. "AN ACT concerning civil law", approved August
622, 2005, Public Act 94-653, is amended by changing Section 5
7as follows:
 
8    (P.A. 94-653, Sec. 5)
9    Sec. 5. The Illinois Department of Human Services is hereby
10authorized to grant and convey a permanent conservation
11easement to the Illinois Department of Natural Resources or to
12the Chicago Park District on a parcel containing 30 acres, more
13or less, that is located in Section 18, Township 40 North,
14Range 13 East of the third principal meridian, Cook County,
15Illinois, situated to the West and South of the Chicago Read

1Mental Health Center, for the purpose of preserving and
2protecting the wetlands and forested area for the benefit of
3the patients of the facility, the community, and the general
4public, this 30-acre parcel being more particularly described

8    Section 1-10. "An Act concerning civil law", approved
9August 22, 2005, Public Act 94-653, is amended by repealing
10Section 10.

ARTICLE 2.

 
12    Section 2-5. The Director of the Department of Natural
13Resources, on behalf of the State of Illinois, is authorized to
14terminate all contractual interests of the State of Illinois
15provided in the Agreement between the State of Illinois,
16through the former Department of Conservation, and the City of
17Pana, a Municipal Corporation, situated in Christian County,
18made on June 28, 1949, for the purpose of funding the
19construction of a dam and water reservoir to create the Pana
20Lake Project.
 
21    Section 2-10. The State of Illinois contractual interests
22authorized to be terminated by this Act include the following:

1    (1) Rights to develop, manage, and maintain any and all of
2the lands associated with the Pana Lake Project, as described
3in Exhibit A of the Agreement, as part of a Statewide lake,
4water storage, and public recreation system, including public
5hunting and fishing grounds development of game management and
6reforestation and to use said area for the preservation and
7propagation of fish and wildlife thereon for 99 years.
8    (2) Obligation of the City of Pana to maintain the Pana
9Lake Project at its own sole cost and expense and keep in good
10repair at all times the dam and all facilities erected in
11connection therewith.
12    (3) Right to purchase the land occupied by the Pana Lake
13Project if the City of Pana shall at any time determine to sell
14such land and the improvements thereon.
 
15    Section 2-15. The State of Illinois paid $100,000 toward
16the Pana Lake Project in consideration for obtaining the
17foregoing contractual interests pursuant to appropriation of
18State funds for the purpose made in Section 4 of Senate Bill
19662 by the 65th General Assembly, approved July 21, 1947.
 
20    Section 2-20. The State of Illinois shall not receive
21consideration for the termination of its contractual rights of
22the June 28, 1949 Agreement.
 
23    Section 2-25. The Director of the Department of Natural

1Resources may execute a mutual termination with the City of
2Pana terminating both parties' interests in the June 28, 1949
3Agreement.

ARTICLE 3.

 
5    Section 3-5. The Director of the Department of Natural
6Resources, on behalf of the State of Illinois, is authorized to
7execute and deliver to the Forest Preserve District of Will
8County, a forest preserve district organized and existing under
9the laws of the State of Illinois, of the County of Will, State
10of Illinois, for and in consideration of $1 paid to the
11Department, a quitclaim deed to the following described real
12property, to wit:
 
13    A tract conveyed to the State of Illinois by Document No.
14R75-17163, dated July 3, 1975 in County of Will, State of
15Illinois, description as follows:
 
16    The South half of Lot l, Lots 2, 3, 5, 6, 8, 9, 11, 12, 13,
17    14, 15, 16, 17, 18, 19, and 20 in the Subdivision of the
18    Southwest quarter of Section 1, in Township 34 North and in
19    Range 13 East of the Third Principal Meridian, according to
