| 2 | | Sec. 10-1-7.4. Temporary fire chief and paramedic chief |
| 3 | | advisory board. |
| 4 | | (a) As used in this Section, "fire chief" or "paramedic |
| 5 | | chief" means an individual temporarily appointed by the Fire |
| 6 | | Commissioner to have direct supervisory authority over sworn |
| 7 | | firefighters, paramedics, or emergency medical technicians of |
| 8 | | the Chicago Fire Department. |
| 9 | | (b) A advisory board is created in the Chicago Fire |
| 10 | | Department to recommend to the Fire Commissioner of the Chicago |
| 11 | | Fire Department the best candidates for each position of fire |
| 12 | | chief or paramedic chief with a goal of a diverse fire |
| 13 | | department that reflects the diversity of the City of Chicago. |
| 14 | | The advisory board shall be comprised of 8 members appointed by |
| 15 | | the Fire Commissioner, or his or her designee, 4 of whom must |
| 16 | | be, at the time of appointment and during all times while |
| 17 | | serving on the advisory board: (i) a member of an organization |
| 18 | | representing the interest of firefighters and paramedics of the |
| 19 | | Chicago Fire Department; and (ii) elected at large by members |
| 20 | | of that organization to the organization's executive board. The |
| 21 | | Fire Commissioner shall make his or her initial appointments to |
| 22 | | the advisory board no later than 60 days after the effective |
| 23 | | date of this amendatory Act of the 101st General Assembly. The |
| 24 | | advisory board shall meet no later than 90 days after the |
| 25 | | effective date of this amendatory Act of the 101st General |
| 26 | | Assembly to elect a chair and vice-chair. Beginning June 1, |

| 1 | | 2020, and every June 1 thereafter, members shall be appointed |
| 2 | | or reappointed to one-year terms and each newly-appointed |
| 3 | | advisory board shall meet no later than July 1 of each year to |
| 4 | | elect a chair and vice-chair. |
| 5 | | (c) The Fire Commissioner shall provide written notice to |
| 6 | | the advisory board each time the Fire Commissioner will need to |
| 7 | | make an appointment of a fire chief or paramedic chief. The |
| 8 | | Fire Commissioner must provide with the written notice to the |
| 9 | | advisory board a list of candidates for each position that he |
| 10 | | or she will need to make an appointment, including which |
| 11 | | candidates meet the criteria under subsection (d). The advisory |
| 12 | | board shall meet no later than 30 days after receipt of each |
| 13 | | written notice from the Fire Commissioner and shall issue a |
| 14 | | recommendation or recommendations to the Fire Commissioner no |
| 15 | | later than 15 days after the initial meeting. In order to be |
| 16 | | recommended for the position of fire chief or paramedic chief, |
| 17 | | 5 members of the advisory board must agree to the |
| 18 | | recommendation. |
| 19 | | (d) The Fire Commissioner may appoint a fire chief or |
| 20 | | paramedic chief after the advisory board has issued its |
| 21 | | recommendation under subsection (c). An individual appointed |
| 22 | | fire chief or paramedic chief by the Fire Commissioner must |
| 23 | | meet the following criteria: |
| 24 | | (1) is an active member of the Chicago Fire Department |
| 25 | | who is not receiving any type of pension from the Firemen's |
| 26 | | Annuity and Benefit Fund of Chicago; |

| 1 | | (2) has 10 years of creditable service time with the |
| 2 | | Chicago Fire Department; |
| 3 | | (3) has held the career service rank of battalion chief |
| 4 | | or field chief with the Chicago Fire Department prior to |
| 5 | | his or her appointment to the rank of fire chief or |
| 6 | | paramedic chief; and |
| 7 | | (4) does not exceed the maximum age set forth in the |
| 8 | | ordinances of the City of Chicago that govern active sworn |
| 9 | | members of the Chicago Fire Department. |
| 10 | | However, the Fire Commissioner may appoint any individual |
| 11 | | recommended by the advisory board under subsection (c) even if |
| 12 | | they do not meet the criteria in this subsection. |
| 13 | | (e) The advisory board shall adopt all necessary rules and |
| 14 | | procedures it finds necessary to carry out the process of |
| 15 | | recommending qualified candidates. The City of Chicago shall |
| 16 | | provide administrative and other support to the advisory board. |
| 17 | | (f) The City of Chicago may not regulate the advisory board |
| 18 | | or regulate appointments of fire chiefs or paramedic chiefs in |
| 19 | | the Chicago Fire Department in a manner inconsistent with this |
| 20 | | Section. This Section is a limitation under subsection (i) of |
| 21 | | Section 6 of Article VII of the Illinois Constitution on the |
| 22 | | concurrent exercise by home rule units of powers and functions |
| 23 | | exercised by the State.

| 24 | | Section 99. Effective date. This Act takes effect upon |
| 25 | | becoming law.".
