| 1 | | within Agency records, municipalities, counties, solid waste |
| 2 | | management associations, companies, corporations, and |
| 3 | | individuals. The following factors shall be considered: |
| 4 | | (1) the presence of, and depth to, any aquifer with |
| 5 | | potential potable use; |
| 6 | | (2) whether the landfill has an engineered liner |
| 7 | | system; |
| 8 | | (3) whether the landfill has an active groundwater |
| 9 | | monitoring system; |
| 10 | | (4) whether waste disposal occurred within the |
| 11 | | 100-year floodplain; and |
| 12 | | (5) landfills within the setback zone of any potable |
| 13 | | water supply well. |
| 14 | | (c) Subject to appropriation, the Agency shall use existing |
| 15 | | information available from State and federal agencies, such as |
| 16 | | the Prairie Research Institute, the Department of Natural |
| 17 | | Resources, the Illinois Emergency Management Agency, the |
| 18 | | Federal Emergency Management Agency, and the Natural Resources |
| 19 | | Conservation Service, to identify unpermitted waste disposal |
| 20 | | sites located within the boundaries of the Mahomet Aquifer that |
| 21 | | may pose a threat to surface water or groundwater resources. |
| 22 | | (d) Subject to appropriation, the Prairie Research |
| 23 | | Institute shall offer training to instruct landfill inspectors |
| 24 | | in the use of remote sensing technologies, geographic |
| 25 | | information systems, and current database management |
| 26 | | technologies for the routine inspection and management of |

| 1 | | landfills. The training shall include, among other things, |
| 2 | | instruction in: |
| 3 | | (1) the preparation of georeferenced image maps and the |
| 4 | | use of aerial photography and other remote sensing |
| 5 | | technologies, such as Light Detection and Ranging (LiDAR), |
| 6 | | to identify land erosion, landslides, barren areas, |
| 7 | | leachate seeps, vegetation, and other relevant surface and |
| 8 | | subsurface features of the landfills; and |
| 9 | | (2) the use of geographic information systems and |
| 10 | | remote sensing technologies to identify site defects, |
| 11 | | structures, and monitoring wells, and to otherwise assist |
| 12 | | in the routine inspection and management of landfills. |
| 13 | | The Prairie Research Institute shall provide the Agency |
| 14 | | with updates on developments in remote sensing technologies, |
| 15 | | geographic information systems, and current database |
| 16 | | management technologies that have the potential to improve the |
| 17 | | routine inspection and management of landfills. |
| 18 | | (e) The Agency shall use its own data, along with data from |
| 19 | | municipalities, counties, solid waste management associations, |
| 20 | | companies, corporations, and individuals, to archive |
| 21 | | information about landfills for present and long-term use. The |
| 22 | | resulting records shall be available for use as confidential |
| 23 | | information by regulatory agencies, but shall not be subject to |
| 24 | | the Freedom of Information Act. |
| 25 | | (f) The Agency shall further assemble location information |
| 26 | | about industries and companies that generate waste, including |

| 1 | | from historical processes. The resulting records shall be |
| 2 | | available for use as confidential information by regulatory |
| 3 | | agencies but shall not be subject to the Freedom of Information |
| 4 | | Act. |
| 5 | | Section 10. The Illinois Groundwater Protection Act is |
| 6 | | amended by adding Section 10 as follows: |
| 7 | | (415 ILCS 55/10 new) |
| 8 | | Sec. 10. Pekin Metro Landfill pilot projects. Subject to |
| 9 | | appropriation, the Agency shall design and implement up to 2 |
| 10 | | pilot studies of landfills that overlie the Mahomet Aquifer to |
| 11 | | identify threats to surface and groundwater resources that are |
| 12 | | posed by the landfills. One of the pilot projects shall be |
| 13 | | conducted at the Pekin Metro Landfill in Tazewell County. In |
| 14 | | conducting the pilot projects, the Agency shall: |
| 15 | | (1) inspect and identify potential and current |
| 16 | | contamination threats to the water quality of aquifers in the |
| 17 | | same watershed as the landfill (for the Pekin Metro Landfill, |
| 18 | | the Mahomet Aquifer); |
| 19 | | (2) use geographic information systems and remote sensing |
| 20 | | technology to track defects, structures, appliances, and wells |
| 21 | | for routine inspection and sustainable management; |
| 22 | | (3) install or repair groundwater monitoring mechanisms |
| 23 | | necessary to identify whether contaminants from the landfill |
| 24 | | are affecting water quality in the Mahomet Aquifer; |

| 1 | | (4) identify and provide cost estimates for any additional |
| 2 | | response actions necessary or appropriate to reduce or minimize |
| 3 | | potential threats to human health and the environment resulting |
| 4 | | from current landfill conditions; and |
| 5 | | (5) utilize the information and data collected from the |
| 6 | | project to create best management practices for addressing |
| 7 | | other landfills throughout the State.".
