| 3 | | (c) The Secretary of State shall include, in the Illinois |
| 4 | | Rules of the Road publication, information advising drivers to |
| 5 | | use the Dutch Reach method when opening a vehicle door after |
| 6 | | parallel parking on a street (checking the rear-view mirror, |
| 7 | | checking the side-view mirror, then opening the door with the |
| 8 | | right hand, thereby reducing the risk of injuring a bicyclist |
| 9 | | or opening the door in the path a vehicle approaching from |
| 10 | | behind). |
| 11 | | (d) The Secretary of State shall include, in the Illinois
|
| 12 | | Rules of the Road publication, information advising drivers to
|
| 13 | | use the zipper merge method when merging into a reduced number
|
| 14 | | of lanes (drivers in merging lanes are expected to use both
|
| 15 | | lanes to advance to the lane reduction point and merge at that
|
| 16 | | location, alternating turns). |

| 19 | | Sec. 6-109. Examination of Applicants. |
| 20 | | (a) The Secretary of State shall examine every applicant |
| 21 | | for a driver's
license or permit who has not been previously |
| 22 | | licensed as a driver under the
laws of this State or any other |
| 23 | | state or country, or any applicant for renewal
of such driver's |
| 24 | | license or permit when such license or permit has been expired
|
| 25 | | for more than one year. The Secretary of State shall, subject |
|

| 1 | | to the
provisions of paragraph (c), examine every licensed |
| 2 | | driver at least every 8
years, and may examine or re-examine |
| 3 | | any other applicant or licensed driver,
provided that during |
| 4 | | the years 1984 through 1991 those drivers issued a license
for |
| 5 | | 3 years may be re-examined not less than every 7 years or more |
| 6 | | than every
10 years. |
| 7 | | The Secretary of State shall require the testing of the |
| 8 | | eyesight of any
driver's license or permit applicant who has |
| 9 | | not been previously licensed
as a driver under the laws of this |
| 10 | | State and shall promulgate rules and
regulations to provide for |
| 11 | | the orderly administration of all the provisions of
this |
| 12 | | Section. |
| 13 | | The Secretary of State shall include at least one test |
| 14 | | question that concerns the provisions of the Pedestrians with |
| 15 | | Disabilities Safety Act in the question pool used for the |
| 16 | | written portion of the driver's drivers license examination |
| 17 | | within one year after July 22, 2010 (the effective date of |
| 18 | | Public Act 96-1167). |
| 19 | | The Secretary of State shall include, in the question pool |
| 20 | | used for the written portion of the driver's license |
| 21 | | examination, test questions concerning safe driving in the |
| 22 | | presence of bicycles, of which one may be concerning the Dutch |
| 23 | | Reach method as described in Section 2-112. |
| 24 | | The Secretary of State shall include, in the question pool |
| 25 | | used for the written portion of the driver's license |
| 26 | | examination, at least one test question concerning driver |

| 1 | | responsibilities when approaching a stationary emergency |
| 2 | | vehicle as described in Section 11-907. |
| 3 | | (b) Except as provided for those applicants in paragraph |
| 4 | | (c), such
examination shall include a test of the applicant's
|
| 5 | | eyesight, his or her ability to read and understand official |
| 6 | | traffic control devices,
his or her knowledge of safe driving |
| 7 | | practices and the traffic laws of this State,
and may include |
| 8 | | an actual demonstration of the applicant's ability to exercise
|
| 9 | | ordinary and reasonable control of the operation of a motor |
| 10 | | vehicle, and
such further physical and mental examination as |
| 11 | | the Secretary of State finds
necessary to determine the |
| 12 | | applicant's fitness to operate a motor vehicle
safely on the |
| 13 | | highways, except the examination of an applicant 75 years
of |
| 14 | | age or older shall include an actual demonstration of the |
| 15 | | applicant's
ability to exercise ordinary and reasonable |
| 16 | | control of the operation of
a motor vehicle. All portions of |
| 17 | | written and verbal examinations under
this Section, excepting |
| 18 | | where the English language appears on facsimiles
of road signs, |
| 19 | | may be given in the Spanish language and, at the discretion
of |
| 20 | | the Secretary of State, in any other language as well as in |
| 21 | | English upon
request of the examinee. Deaf persons who are |
| 22 | | otherwise qualified are not
prohibited from being issued a |
| 23 | | license, other than a commercial driver's
license, under this |
| 24 | | Code. |
| 25 | | (c) Re-examination for those applicants who at the time of |
| 26 | | renewing their
driver's license possess a driving record devoid |

| 1 | | of any convictions of traffic
violations or evidence of |
| 2 | | committing an offense
for which mandatory revocation
would be |
| 3 | | required upon conviction pursuant to Section 6-205 at the time
|
| 4 | | of renewal shall be in a manner prescribed by the Secretary
in |
| 5 | | order to determine an applicant's ability to safely operate a |
| 6 | | motor
vehicle,
except that every applicant for the renewal of a |
| 7 | | driver's license who is
75 years of age or older must prove, by |
| 8 | | an actual demonstration,
the applicant's ability to exercise |
| 9 | | reasonable care in the safe operation
of a motor vehicle. |
| 10 | | (d) In the event the applicant is not ineligible under the |
| 11 | | provisions of
Section 6-103 to receive a driver's license, the |
| 12 | | Secretary of State
shall make provision for giving an |
| 13 | | examination, either in the county where
the applicant resides |
| 14 | | or at a place adjacent thereto reasonably convenient
to the |
| 15 | | applicant, within not more than 30 days from the date said
|
| 16 | | application is received. |
| 17 | | (e) The Secretary of State may adopt rules regarding the |
| 18 | | use of foreign language interpreters during the application and |
| 19 | | examination process. |

| 24 | | (a) The Move Over Task Force is created to study the issue |
| 25 | | of violations of Sections 11-907, 11-907.5, and 11-908 with |
|

| 1 | | particular attention to the causes of violations and ways to |
| 2 | | protect law enforcement and emergency responders. |
| 3 | | (b) The membership of the Task Force shall consist of the |
| 4 | | following members: |
| 5 | | (1) the Director of State Police or his or her |
| 6 | | designee, who shall serve as chair; |
| 7 | | (2) the Governor or his or her designee; |
| 8 | | (3) the Secretary of State or his or her designee; |
| 9 | | (4) the Secretary of Transportation or his or her |
| 10 | | designee; |
| 11 | | (5) the Director of the Illinois Toll Highway Authority |
| 12 | | or his or her designee; |
| 13 | | (6) the President of the Illinois State's Attorneys |
| 14 | | Association or his or her designee; |
| 15 | | (7) the President of the Illinois Association of Chiefs |
| 16 | | of Police or his or her designee; |
| 17 | | (8) the President of the Illinois Sheriffs' |
| 18 | | Association or his or her designee; |
| 19 | | (9) the President of the Illinois Fraternal Order of |
| 20 | | Police or his or her designee; |
| 21 | | (10) the President of the Associated Fire Fighters of |
| 22 | | Illinois or his or her designee; |
| 23 | | (11) one member appointed by the Speaker of the House |
| 24 | | of Representatives; |
| 25 | | (12) one member appointed by the Minority Leader of the |
| 26 | | House of Representatives; |

| 7 | | trucking associations; |
| 8 | | (B) one representative of a Chicago area motor |
| 9 | | club; |
| 10 | | (C) one representative of a Chicago area transit |
| 11 | | safety alliance; |
| 12 | | (D) one representative of a statewide press |
| 13 | | association; |
| 14 | | (E) one representative of a statewide broadcast |
| 15 | | association; |
| 16 | | (F) one representative of a statewide towing |
| 17 | | organization; |
| 18 | | (G) the chief of police of a municipality with a |
| 19 | | population under 25,000; |
| 20 | | (H) one representative of a statewide organization |
| 21 | | representing chiefs of police; and |
| 22 | | (I) one representative of the solid waste |
| 23 | | management industry. |
| 24 | | (c) The members of the Task Force shall serve without |
| 25 | | compensation. |
| 26 | | (d) The Task Force shall meet no fewer than 3 times and |

| 1 | | shall present its report and recommendations, including |
| 2 | | legislative recommendations, if any, on how to better enforce |
| 3 | | Scott's Law and prevent fatalities on Illinois roadways to the |
| 4 | | General Assembly no later than January 1, 2020. |
| 5 | | (e) The Department of State Police shall provide |
| 6 | | administrative support to the Task Force as needed. |
| 7 | | (f) This Section is repealed on January 1, 2021.".
