    Amends various Acts relating to the governance of public universities and community colleges in Illinois. Provides that if a student has a personal support worker through the Home-Based Support
Services Program for Adults with Mental Disabilities under the
Developmental Disability and Mental Disability Services Act, the governing board of the public university or community college district must permit the personal support worker to attend class with the student but is not responsible for providing or paying for the personal support worker.  Provides that if the personal support worker's attendance in class is solely to provide personal support services to the student, the governing board may not charge the personal support worker tuition and fees for such attendance. Effective immediately.

1    AN ACT concerning education.

 
2    Be it enacted by the People of the State of Illinois,
 
3represented in the General Assembly:


 
4    Section 5. The University of Illinois Act is amended  by 
5adding Section 120 as follows:
 
6    (110 ILCS 305/120 new)
7    Sec. 120. Personal support worker's attendance in class 
8permitted. If a student of the University has a personal 
9support worker through the Home-Based Support
Services Program 
10for Adults with Mental Disabilities under the
Developmental 
11Disability and Mental Disability Services Act, the Board of 
12Trustees must permit the personal support worker to attend 
13class with the student but is not responsible for providing or 
14paying for the personal support worker.  If the personal support 
15worker's attendance in class is solely to provide personal 
16support services to the student, the Board may not charge the 
17personal support worker tuition and fees for such attendance.
 
18    Section 10. The Southern Illinois University Management 
19Act is amended  by adding Section 100 as follows:

6    Sec. 35-215. Personal support worker's attendance in class 
7permitted. If a student of the University has a personal 
8support worker through the Home-Based Support
Services Program 
9for Adults with Mental Disabilities under the
Developmental 
10Disability and Mental Disability Services Act, the Board must 
11permit the personal support worker to attend class with the 
12student but is not responsible for providing or paying for the 
13personal support worker.  If the personal support worker's 
14attendance in class is solely to provide personal support 
15services to the student, the Board may not charge the personal 
16support worker tuition and fees for such attendance.
 
17    Section 50. The Public Community College Act is amended  by 
18adding Section 3-29.14 as follows:
 
19    (110 ILCS 805/3-29.14 new)
20    Sec. 3-29.14. Personal support worker's attendance in 
21class permitted. If a student of a community college district 
22has a personal support worker through the Home-Based Support

2Developmental Disability and Mental Disability Services Act, 
3the board must permit the personal support worker to attend 
4class with the student but is not responsible for providing or

9    Section 99. Effective date. This Act takes effect upon 
10becoming law.
