| 1 | AMENDMENT TO SENATE BILL 2462

| 2 | AMENDMENT NO. ______. Amend Senate Bill 2462, AS AMENDED, | ||||||
| 3 | in the introductory clause of Section 5, by replacing "143.10d | ||||||
| 4 | and 143.10e" with "143.10d, 143.10e, and 143.10f"; and
| ||||||
| 5 | in Section 5, in Sec. 143.10d, by inserting immediately after | ||||||
| 6 | subsection (c) the following: | ||||||
| 7 | "(d) An insurer may not ask or inquire about a specific | ||||||
| 8 | breed, size, or weight of a dog upon the insured property, but | ||||||
| 9 | may ask or inquire about the number of dogs on the property | ||||||
| 10 | before or after issuing a policy or contract insuring against | ||||||
| 11 | liability for injury to a person or against liability for | ||||||
| 12 | injury to or destruction of property, arising out of ownership, | ||||||
| 13 | lease, or rental of residential one, 2, 3, or 4 dwelling real | ||||||
| 14 | property."; and
| ||||||
| 15 | in Section 5, by inserting immediately after the end of Sec. | ||||||
| 16 | 143.10e the following: | ||||||

| 1 | "(215 ILCS 5/143.10f new) | ||||||
| 2 | Sec. 143.10f. Annual report and list of dogs not covered. | ||||||
| 3 | (a) The Department shall annually require every insurance | ||||||
| 4 | company offering homeowner's insurance coverage or renter's | ||||||
| 5 | insurance coverage that issues a policy or contract insuring | ||||||
| 6 | against liability for injury to a person or injury to or | ||||||
| 7 | destruction of property arising out of the ownership, lease, or | ||||||
| 8 | rental of residential property to report any breeds or mixes of | ||||||
| 9 | dogs that are not covered. | ||||||
| 10 | (b) The Department shall annually list the pet dog-friendly | ||||||
| 11 | insurance companies that do not discriminate against any breed | ||||||
| 12 | or mix of dog on its website and shall also list the companies | ||||||
| 13 | that discriminate against breeds of dogs and include the list | ||||||
| 14 | of breeds or mixes of dogs each company discriminates against. | ||||||
| 15 | A company shall not add breeds or mixes of dogs to its dog | ||||||
| 16 | breed discrimination list unless it gets approval from the | ||||||
| 17 | Department to do so by submitted credible data to the | ||||||
| 18 | Department explaining why it is seeking to add another breed or | ||||||
| 19 | mix of dog to its dog breed discrimination list.".
