AMENDMENT TO SENATE BILL 3060 




2    AMENDMENT NO. ______. Amend Senate Bill 3060 on page 1, 
3line 5, after "Section 41", by inserting "and by adding Section 
443"; and

 
5on page 2, immediately below line 2, by inserting the 
6following:
 
7    "(225 ILCS 85/43 new)
8    Sec. 43. Disclosure of pharmacy retail price.
9    (a) For the purpose of this Section:
10    "Pharmacy retail price" means the price an individual 
11without prescription drug coverage or not using any other 
12prescription medication benefit or discount would pay at a 
13retail pharmacy, not including a pharmacist dispensing fee.
14    "Cost-sharing amount" means the amount owed by a 
15policyholder under the terms of his or her health insurance 
16policy or as required by a pharmacy benefit manager as defined

1in subsection (a) of Section 513b1 of the Illinois Insurance 
2Code.
3    (b) A pharmacist or his or her authorized employee must 
4disclose to the consumer at the point of sale the current 
5pharmacy retail price for each prescription medication the 
6consumer intends to purchase. If the consumer's cost-sharing 
7amount for a prescription exceeds the current pharmacy retail 
8price, the pharmacist or his or her authorized employee must 
9disclose to  the consumer that the pharmacy retail price is less 
10than the patient's cost-sharing amount.".
