| 1 | | AN ACT concerning State government.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Illinois Criminal Justice Information Act |
| 5 | | is amended by adding Section 9.4 as follows:
|
| 6 | | (20 ILCS 3930/9.4 new) |
| 7 | | Sec. 9.4. Statewide Deferred Prosecution Funding Program. |
| 8 | | The Statewide Deferred Prosecution Funding Program Fund is |
| 9 | | hereby created as a special fund in the State treasury. Grants |
| 10 | | from the Fund shall be made, subject to appropriation, by the |
| 11 | | Illinois Criminal Justice Information Authority to State's |
| 12 | | Attorneys upon application in the amount of 25% of the costs |
| 13 | | incurred by the county to operate the deferred prosecution |
| 14 | | program. To be eligible to receive moneys from the Fund, a |
| 15 | | State's Attorney must provide a deferred prosecution program |
| 16 | | that allows for a misdemeanor charge to be dismissed upon |
| 17 | | successful completion of the deferred prosecution program |
| 18 | | created by the State's Attorney. The Authority shall by rule |
| 19 | | provide selection criteria and procedures for grants to be |
| 20 | | made under this Section.
