Amends the Humane Care for Animals Act. Provides that no person may knowingly allow an animal to ingest cannabis, including second-hand smoke, or cannabis-infused products in a way that results in the animal's sickness or death. Provides that a first violation is a Class A misdemeanor, and a second or subsequent violation is a Class 4 felony. Effective immediately.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Humane Care for Animals Act is amended by |
| 5 | | adding Section 6.5 as follows: |
| 6 | | (510 ILCS 70/6.5 new) |
| 7 | | Sec. 6.5. Animal ingestion of cannabis or cannabis-infused |
| 8 | | product. |
| 9 | | (a) As used in this Section, "cannabis" and |
| 10 | | "cannabis-infused product" have the meanings given to those |
| 11 | | terms in the Cannabis Regulation and Tax Act. |
| 12 | | (b) No person may knowingly allow an animal to ingest |
| 13 | | cannabis, including second-hand smoke, or cannabis-infused |
| 14 | | products in a way that results in the animal's sickness or |
| 15 | | death. |
| 16 | | (c) A person convicted of violating this Section is guilty |
| 17 | | of a Class A misdemeanor. A second or subsequent violation is a |
| 18 | | Class 4 felony.

| 19 | | Section 99. Effective date. This Act takes effect upon |
| 20 | | becoming law.
