| 1 | | AN ACT concerning public aid.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Illinois Public Aid Code is amended by |
| 5 | | adding Section 12-4.54 as follows:
|
| 6 | | (305 ILCS 5/12-4.54 new) |
| 7 | | Sec. 12-4.54. SNAP, WIC; diapers, menstrual hygiene |
| 8 | | products. If the United States Department of Agriculture's |
| 9 | | Food and Nutrition Service creates and makes available to the |
| 10 | | states a waiver permitting recipients of benefits provided |
| 11 | | under the Supplemental Nutrition Assistance Program or the |
| 12 | | Special Supplemental Nutrition Program for Women, Infants, and |
| 13 | | Children to use their benefits to purchase diapers or |
| 14 | | menstrual hygiene products such as tampons, sanitary napkins, |
| 15 | | and feminine wipes, then the Department of Human Services |
| 16 | | shall apply for the waiver. If the United States Department of |
| 17 | | Agriculture approves the Department of Human Services' waiver |
| 18 | | application, then the Department of Human Services shall adopt |
| 19 | | rules and make other changes as necessary to implement the |
| 20 | | approved waiver.
