SYNOPSIS AS INTRODUCED:

New Act

Creates the Carbon Capture, Utilization, and Storage Legislation Task Force Act. Creates the Carbon Capture, Utilization, and Storage Legislation Task Force. Adds provisions governing Task Force membership, duties, powers, and compensation. Provides that the Task Force shall meet no less than once a month beginning in July 2021. Provides that the Task Force shall submit a report to the Governor and the General Assembly on or before December 31, 2021. Dissolves the Task Force upon the filing of the report. Provides that the Act is repealed on January 1, 2023. Effective immediately.

A BILL FOR

AN ACT concerning civil law.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 1. Short title. This Act may be cited as the Carbon Capture, Utilization, and Storage Legislation Task Force Act.

Section 5. Carbon Capture, Utilization, and Storage Legislation Task Force.

(a) The Carbon Capture, Utilization, and Storage Legislation Task Force is created and shall include the following members:

(1) the Director of the Department of Natural Resources, or his or her designee, who shall serve as the ex officio chairperson of the Task Force;

(2) one member appointed by the Speaker of the House of Representatives;

(3) one member appointed by the President of the Senate;

(4) one member appointed by the Minority Leader of the House of Representatives;

(5) one member appointed by the Minority Leader of the Senate;

(6) the Director of the Illinois Environmental Protection Agency, or his or her designee;

(7) two members appointed by the Executive Director of the Prairie Research Institute of the University of Illinois at Urbana-Champaign; and

(8) the following members appointed by the Governor:

(i) one member with legal expertise;

(ii) one member with financial expertise;

(iii) one member representing the State's largest general farm organization;

(iv) one member representing a statewide environmental organization;

(v) one member representing a national environmental organization;

(vi) one member representing the corn industry;

(vii) one member representing the natural gas industry;

(viii) one member representing a business that is considering a carbon capture, utilization, and storage project;

(ix) one member representing a business that is currently performing a carbon capture, utilization, and storage project;

(x) one member representing an energy business that has global experience and investments in carbon capture, utilization, and storage technologies; and

(xi) one member representing a statewide labor federation that represents more than one international union recognized under the National Labor Relations Act.

(b) The Director of the Department of Natural Resources may retain services from outside parties with legal, engineering, and financial expertise to assist the Task Force in carrying out its duties.

(c) Task Force members are not eligible to receive compensation or reimbursement of expenses.

Section 10. Report on carbon capture, utilization, and storage legislation.

(a) The Task Force shall meet no less than once a month beginning in July 2021.

(b) The Task Force shall submit a report to the Governor and the General Assembly on or before December 31, 2021 of its recommendations on all issues deemed appropriate to carbon capture, utilization, and storage legislation, including, but not limited to:

(1) a recommended plan to develop carbon capture, utilization, and storage in the State that both protects the environment and supports short-term and long-term economic growth;

(2) ownership of the carbon dioxide in a carbon capture, utilization, and storage project;

(3) liability for the storage and monitoring maintenance of the carbon dioxide after the completion of a carbon capture, utilization, and storage project;

(4) acquisition, ownership, and amalgamation of pore space;

(5) procedures and safeguards for the capture, utilization, and storage of carbon dioxide;

(6) methodology to establish any necessary fees, costs, or offsets;

(7) potential uses of carbon dioxide;

(8) coordination with applicable federal law or regulatory commissions, including the Class VI injection well permitting process;

(9) creation of rules to develop carbon dioxide pipelines and their related issues;

(10) development of knowledge capacity of appropriate State agencies and stakeholders; and

(11) a recommended plan for the leveraging of public-private partnerships for research, design, and development to benefit the State.

(c) The Task Force is dissolved upon the filing of its report with the General Assembly.

Section 15. Repeal. This Act is repealed on January 1, 2023.

Section 99. Effective date. This Act takes effect upon becoming law.
