| 1 | AN ACT concerning civil law.
| |||||||||||||||||||
| 2 | Be it enacted by the People of the State of Illinois,
| |||||||||||||||||||
| 3 | represented in the General Assembly:
| |||||||||||||||||||
| 4 | Section 1. Short title. This Act may be cited as the Carbon | |||||||||||||||||||
| 5 | Capture, Utilization, and Storage Legislation Task Force Act. | |||||||||||||||||||
| 6 | Section 5. Carbon Capture, Utilization, and Storage | |||||||||||||||||||
| 7 | Legislation Task Force. | |||||||||||||||||||
| 8 | (a) The Carbon Capture, Utilization, and Storage | |||||||||||||||||||
| 9 | Legislation Task Force is created and shall include the | |||||||||||||||||||
| 10 | following members: | |||||||||||||||||||
| 11 | (1) the Director of the Department of Natural | |||||||||||||||||||
| 12 | Resources, or his or her designee, who shall serve as the | |||||||||||||||||||
| 13 | ex officio chairperson of the Task Force; | |||||||||||||||||||
| 14 | (2) one member appointed by the Speaker of the House | |||||||||||||||||||
| 15 | of Representatives; | |||||||||||||||||||
| 16 | (3) one member appointed by the President of the | |||||||||||||||||||
| 17 | Senate; | |||||||||||||||||||
| 18 | (4) one member appointed by the Minority Leader of the | |||||||||||||||||||
| 19 | House of Representatives; | |||||||||||||||||||
| 20 | (5) one member appointed by the Minority Leader of the | |||||||||||||||||||
| 21 | Senate; | |||||||||||||||||||
| 22 | (6) the Director of the Illinois Environmental | |||||||||||||||||||
| 23 | Protection Agency, or his or her designee; | |||||||||||||||||||
| |||||||
| |||||||
| 1 | (7) two members appointed by the Executive Director of | ||||||
| 2 | the Prairie Research Institute of the University of | ||||||
| 3 | Illinois at Urbana-Champaign; and | ||||||
| 4 | (8) the following members appointed by the Governor: | ||||||
| 5 | (i) one member with legal expertise; | ||||||
| 6 | (ii) one member with financial expertise; | ||||||
| 7 | (iii) one member representing the State's largest | ||||||
| 8 | general farm organization; | ||||||
| 9 | (iv) one member representing a statewide | ||||||
| 10 | environmental organization; | ||||||
| 11 | (v) one member representing a national | ||||||
| 12 | environmental organization; | ||||||
| 13 | (vi) one member representing the corn industry; | ||||||
| 14 | (vii) one member representing the natural gas | ||||||
| 15 | industry; | ||||||
| 16 | (viii) one member representing a business that is | ||||||
| 17 | considering a carbon capture, utilization, and storage | ||||||
| 18 | project; | ||||||
| 19 | (ix) one member representing a business that is | ||||||
| 20 | currently performing a carbon capture, utilization, | ||||||
| 21 | and storage project; | ||||||
| 22 | (x) one member representing an energy business | ||||||
| 23 | that has global experience and investments in carbon | ||||||
| 24 | capture, utilization, and storage technologies; and | ||||||
| 25 | (xi) one member representing a statewide labor | ||||||
| 26 | federation that represents more than one international | ||||||
| |||||||
| |||||||
| 1 | union recognized under the National Labor Relations | ||||||
| 2 | Act. | ||||||
| 3 | (b) The Director of the Department of Natural Resources | ||||||
| 4 | may retain services from outside parties with legal, | ||||||
| 5 | engineering, and financial expertise to assist the Task Force | ||||||
| 6 | in carrying out its duties. | ||||||
| 7 | (c) Task Force members are not eligible to receive | ||||||
| 8 | compensation or reimbursement of expenses. | ||||||
| 9 | Section 10. Report on carbon capture, utilization, and | ||||||
| 10 | storage legislation. | ||||||
| 11 | (a) The Task Force shall meet no less than once a month | ||||||
| 12 | beginning in July 2021. | ||||||
| 13 | (b) The Task Force shall submit a report to the Governor | ||||||
| 14 | and the General Assembly on or before December 31, 2021 of its | ||||||
| 15 | recommendations on all issues deemed appropriate to carbon | ||||||
| 16 | capture, utilization, and storage legislation, including, but | ||||||
| 17 | not limited to: | ||||||
| 18 | (1) a recommended plan to develop carbon capture, | ||||||
| 19 | utilization, and storage in the State that both protects | ||||||
| 20 | the environment and supports short-term and long-term | ||||||
| 21 | economic growth; | ||||||
| 22 | (2) ownership of the carbon dioxide in a carbon | ||||||
| 23 | capture, utilization, and storage project; | ||||||
| 24 | (3) liability for the storage and monitoring | ||||||
| 25 | maintenance of the carbon dioxide after the completion of | ||||||

| 1 | a carbon capture, utilization, and storage project; | ||||||
| 2 | (4) acquisition, ownership, and amalgamation of pore | ||||||
| 3 | space; | ||||||
| 4 | (5) procedures and safeguards for the capture, | ||||||
| 5 | utilization, and storage of carbon dioxide; | ||||||
| 6 | (6) methodology to establish any necessary fees, | ||||||
| 7 | costs, or offsets; | ||||||
| 8 | (7) potential uses of carbon dioxide; | ||||||
| 9 | (8) coordination with applicable federal law or | ||||||
| 10 | regulatory commissions, including the Class VI injection | ||||||
| 11 | well permitting process; | ||||||
| 12 | (9) creation of rules to develop carbon dioxide | ||||||
| 13 | pipelines and their related issues; | ||||||
| 14 | (10) development of knowledge capacity of appropriate | ||||||
| 15 | State agencies and stakeholders; and | ||||||
| 16 | (11) a recommended plan for the leveraging of | ||||||
| 17 | public-private partnerships for research, design, and | ||||||
| 18 | development to benefit the State. | ||||||
| 19 | (c) The Task Force is dissolved upon the filing of its | ||||||
| 20 | report with the General Assembly. | ||||||
| 21 | Section 15. Repeal. This Act is repealed on January 1, | ||||||
| 22 | 2023.
| ||||||
| 23 | Section 99. Effective date. This Act takes effect upon | ||||||
| 24 | becoming law.
