| 1 | AN ACT concerning civil law.
| ||||||
| 2 | Be it enacted by the People of the State of Illinois,
| ||||||
| 3 | represented in the General Assembly:
| ||||||
| 4 | Section 5. The University of Illinois Act is amended by | ||||||
| 5 | adding Section 120 as follows: | ||||||
| 6 | (110 ILCS 305/120 new) | ||||||
| 7 | Sec. 120. Carbon capture, utilization, and storage report. | ||||||
| 8 | (a) Subject to appropriation, the Prairie Research | ||||||
| 9 | Institute at the University of Illinois at Urbana-Champaign, | ||||||
| 10 | in consultation with an intergovernmental advisory committee, | ||||||
| 11 | must file a report on the potential for carbon capture, | ||||||
| 12 | utilization, and storage as a climate mitigation technology | ||||||
| 13 | throughout Illinois with the Governor and the General Assembly | ||||||
| 14 | no later than December 31, 2022. The report must provide an | ||||||
| 15 | assessment of Illinois subsurface storage resources, state of | ||||||
| 16 | readiness, and provide recommendations for policy and | ||||||
| 17 | regulatory needs at the State level based on its findings, and | ||||||
| 18 | shall, at a minimum, address all the following areas: | ||||||
| 19 | (1) carbon capture, utilization, and storage current | ||||||
| 20 | status and future storage resource potential in the State. | ||||||
| 21 | Enhanced Oil Recovery shall remain outside the scope of | ||||||
| 22 | this study; | ||||||
| 23 | (2) procedures, standards, and safeguards for the | ||||||
| |||||||
| |||||||
| 1 | storage of carbon dioxide; | ||||||
| 2 | (3) permitting processes and the coordination with | ||||||
| 3 | applicable federal law or regulatory commissions, | ||||||
| 4 | including the Class VI injection well permitting process; | ||||||
| 5 | (4) economic impact, job creation, and job retention | ||||||
| 6 | from carbon capture, utilization, and storage that both | ||||||
| 7 | protects the environment and supports short-term and | ||||||
| 8 | long-term economic growth; | ||||||
| 9 | (5) development of knowledge capacity of appropriate | ||||||
| 10 | State agencies and stakeholders; | ||||||
| 11 | (6) environmental justice and stakeholder issues | ||||||
| 12 | related to carbon capture, utilization, and storage | ||||||
| 13 | throughout the State; | ||||||
| 14 | (7) leveraging federal policies and public-private | ||||||
| 15 | partnerships for research, design, and development to | ||||||
| 16 | benefit the State; | ||||||
| 17 | (8) liability for the storage and monitoring | ||||||
| 18 | maintenance of the carbon dioxide after the completion of | ||||||
| 19 | a carbon capture, utilization, and storage project; | ||||||
| 20 | (9) acquisition, ownership, and amalgamation of pore | ||||||
| 21 | space for carbon capture, utilization, and storage; | ||||||
| 22 | (10) methodologies to establish any necessary fees, | ||||||
| 23 | costs, or offsets; and | ||||||
| 24 | (11) any risks to health, safety, the environment, and | ||||||
| 25 | property uses or values. | ||||||
| 26 | (b) In developing the report under this Section, the | ||||||

| 1 | Prairie Research Institute shall form an advisory committee, | ||||||
| 2 | which shall be composed of all the following members: | ||||||
| 3 | (1) the Director of the Environmental Protection | ||||||
| 4 | Agency, or his or her designee; | ||||||
| 5 | (2) the Director of Natural Resources, or his or her | ||||||
| 6 | designee; | ||||||
| 7 | (3) the Director of Commerce and Economic Opportunity, | ||||||
| 8 | or his or her designee; | ||||||
| 9 | (4) the Director of the Illinois Emergency Management | ||||||
| 10 | Agency, or his or her designee; | ||||||
| 11 | (5) the Director of Agriculture, or his or her | ||||||
| 12 | designee; | ||||||
| 13 | (6) the Attorney General, or his or her designee; | ||||||
| 14 | (7) one member of the Senate, appointed by the | ||||||
| 15 | President of the Senate; | ||||||
| 16 | (8) one member of the House of Representatives, | ||||||
| 17 | appointed by the Speaker of the House of Representatives; | ||||||
| 18 | (9) one member of the Senate, appointed by the | ||||||
| 19 | Minority Leader of the Senate; and | ||||||
| 20 | (10) one member of the House of Representatives, | ||||||
| 21 | appointed by the Minority Leader of the House of | ||||||
| 22 | Representatives. | ||||||
| 23 | (c) No later than 60 days after the effective date of this | ||||||
| 24 | amendatory Act of the 102nd General Assembly, the advisory | ||||||
| 25 | committee shall hold its first meeting at the call of the | ||||||
| 26 | Executive Director of the Prairie Research Institute, at which | ||||||

| |||||||
| 1 | meeting the members shall select a chairperson from among | ||||||
| 2 | themselves. After its first meeting, the committee shall meet | ||||||
| 3 | at the call of the chairperson. Members of the committee shall | ||||||
| 4 | serve without compensation. The Prairie Research Committee | ||||||
| 5 | shall provide administrative support to the committee. | ||||||
| 6 | (d) The Prairie Research Institute shall also engage with | ||||||
| 7 | interested stakeholders throughout the State to gain insights | ||||||
| 8 | into socio-economic perspectives from environmental justice | ||||||
| 9 | organizations, environmental non-governmental organizations, | ||||||
| 10 | industry, landowners, farm bureaus, manufacturing, labor | ||||||
| 11 | unions, and others. | ||||||
| 12 | (e) This Section is repealed on January 1, 2023.

| 13 | Section 99. Effective date. This Act takes effect upon | ||||||
| 14 | becoming law. | ||||||
