AMENDMENT TO HOUSE BILL 268 




2    AMENDMENT NO. ______. Amend House Bill 268 by replacing 
3everything after the enacting clause with the following:

 
 
4    "Section 5. The Township Code is amended  by adding Section 
585-70 as follows:
 
6    (60 ILCS 1/85-70 new)
7    Sec. 85-70. Contracts entered into close to or after an 
8election.
9    (a) A township board of trustees or township official may 
10not enter into or authorize an employment, equipment, or 
11service contract during the 14 days before a consolidated 
12election through the third Monday in May following the 
13consolidated election.
14    (b) Notwithstanding subsection (a), a township board or 
15township official may enter into a contract that does not 
16extend more than 60 days after the third Monday of May

1following the consolidated election to address an emergency. 
2As used in this subsection, "emergency" means a condition 
3requiring immediate action to suppress or prevent the spread 
4of disease or to prevent or remove imminent danger to persons 
5or property. 
6    (c) An employment, equipment, or service contract entered 
7into or authorized in violation of this Section is voidable.".
