| 2 | | AMENDMENT NO. ______. Amend House Bill 434 on page 36, |
| 3 | | line, 5, by inserting after the comma the following: |
| 4 | | "and except records concerning the offenses of criminal sexual |
| 5 | | assault, aggravated criminal sexual assault, predatory |
| 6 | | criminal sexual assault of a child, criminal sexual abuse, or |
| 7 | | aggravated criminal sexual abuse, domestic battery, or |
| 8 | | aggravated domestic battery,"; and

| 9 | | on page 40, by inserting immediately below line 1 the |
| 10 | | following: |
| 11 | | "(N) Effect of acquittals. Arrests or charges that |
| 12 | | result in acquittals shall not be used as the basis for |
| 13 | | penalty enhancements in subsequent criminal |
| 14 | | prosecutions.".
