AMENDMENT TO HOUSE BILL 1161 




2    AMENDMENT NO. ______. Amend House Bill 1161 by replacing 
3everything after the enacting clause with the following:

 
4    "Section 5. The School Code is amended  by adding Section 
522-92 as follows:
 
6    (105 ILCS 5/22-92 new)
7    Sec. 22-92. COVID-19 screening and testing reimbursement.
8    (a) In response to the need to prevent, prepare for, and 
9respond to the novel coronavirus disease deemed COVID-19 by 
10the World Health Organization, each school or school district 
11shall be reimbursed by the federal Elementary and Secondary 
12Emergency Education Relief Fund and the ARP Elementary and 
13Secondary School Emergency Relief Fund established under the 
14federal American Rescue Plan Act of 2021 for costs associated 
15with coronavirus surveillance screening and testing. 
16    (b) Coronavirus screening and testing does not require

1emergency use authorization from the United States Food and 
2Drug Administration in order for schools and school districts 
3to seek reimbursement for costs associated with coronavirus 
4surveillance screening and testing from the Elementary and 
5Secondary Emergency Education Relief Fund and the ARP 
6Elementary and Secondary Emergency Education Relief Fund 
7established under the federal American Rescue Plan Act of 
82021.

 
9    Section 99. Effective date. This Act takes effect upon 
10becoming law.".
