| 2 | | Be it enacted by the People of the State of Illinois, |
| 3 | | represented in the General Assembly:
|
| 4 | | Section 5. The Environmental Protection Act is amended by |
| 5 | | changing Section 26 as follows:
|
| 6 | | (415 ILCS 5/26) (from Ch. 111 1/2, par. 1026)

| 7 | | Sec. 26.
The
The Board may adopt such procedural rules as |
| 8 | | may be necessary to
accomplish the purposes of this Act. In |
| 9 | | adopting such rules the Board
shall follow the rulemaking |
| 10 | | procedures of the Illinois Administrative Procedure Act. |
| 11 | | Without limiting the generality of this grant of |
| 12 | | authority, and
notwithstanding any requirement that hearings |
| 13 | | be held in actions brought
pursuant to Titles VIII and X of the |
| 14 | | Act, the Board may adopt procedural
rules for resolution of |
| 15 | | such actions by summary judgment prior to hearing
upon motion |
| 16 | | by either party except as otherwise required by federal law, |
| 17 | | as
well as procedural rules requiring the parties to perfect |
| 18 | | their pleadings
to conform to the evidence as presented to the |
| 19 | | Board.
