AMENDMENT TO HOUSE BILL 3190 




2    AMENDMENT NO. ______. Amend House Bill 3190 by replacing 
3everything after the enacting clause with the following:


 
 
4    "Section 5. The Environmental Protection Act is amended  by 
5adding Section 9.18 as follows:
 
6    (415 ILCS 5/9.18 new)
7    Sec. 9.18. Perfluoroalkyl and polyfluoroalkyl substances.
8    (a) In this Section:
9    "Incineration" includes, but is not limited to, burning, 
10combustion, pyrolysis, gasification, thermal oxidation 
11(including flameless and regenerative), acid recovery furnace 
12or oxidizer, ore roaster, cement kiln, lightweight aggregate 
13kiln, industrial furnace, boiler, and process heater.
14    "Perfluoroalkyl and polyfluoroalkyl substances" means a 
15class of fluorinated organic chemicals containing at least one 
16fully fluorinated carbon atom.

1    (b) The disposal by incineration of aqueous film-forming 
2foam that contains perfluoroalkyl and polyfluoroalkyl 
3substances is prohibited in an area of environmental justice 
4concern.
5    (c) The Agency may adopt rules it deems necessary to carry 
6out the provisions of this Section. 
 
 
7    Section 99. Effective date. This Act takes effect upon 
8becoming law.".
