| 1 | | AN ACT concerning criminal law.

| 2 | | Be it enacted by the People of the State of Illinois,
|
| 3 | | represented in the General Assembly:

| 4 | | Section 5. The Criminal Code of 2012 is amended by adding |
| 5 | | Section 11-1.25 as follows:
|
| 6 | | (720 ILCS 5/11-1.25 new) |
| 7 | | Sec. 11-1.25. Sexual assault by deception. |
| 8 | | (a) A person commits sexual assault by deception if the |
| 9 | | person commits an act of sexual penetration and the person |
| 10 | | submits under the belief that the person committing the act is |
| 11 | | someone known to the victim other than the accused, and this |
| 12 | | belief is induced by pretense or concealment by the accused |
| 13 | | with the intent to induce that belief. |
| 14 | | (b) Sentence. Sexual assault by deception is a Class 3 |
| 15 | | felony.
